  1. I WON!!!! I called the court today and they have not received anything from Lloyds and have instructed me to file my Request for Judgment. So that means I won by default. Thanks to everyone who offered me help and advice I got the result I was after and didn't even need to go to court. My advice to everyone claiming from Lloyds......"Don't be intimidated by them. Just because they day they are going to file a defense, doesn't mean they will. Just stick to your guns" Thanks everyone!
  2. It is now 4 days since LTSB should have filed a defense. I have received nothing in the post from either the bank or the court to say a defense has been submitted. I thought I would have received something either in Fridays or Saturdays post, but nothing. And this morning there is still nothing. Should I wait longer to see if it comes tomorrow or should I file for a judgment now?
  3. Thanks for your post Barty. Just read the bundle link and the one you provided. It states that I should have a copy of my Terms and Conditions. I have had my account for 13 years and no longer have my T's and C's. Is there anywhere I can get a standard copy? Or could I pinch a photocopy from someone? Thought best to start gathering bits for my bundle ready for when I need it.
  4. Got a letter from the court this morning saying that Lloyds intent to defend the whole claim. It now states that they have 28 days from the date of service of the claim form with particulars to file a defense. SO that means that they have 28 days from the 1st of June which will make the 28th/29th June for them to enter their defense. Can anyone tel me what happens then? Will I get a court date? Should I start to prepare my bundle? Anyone sense a hint of panic in my post? Well you'd be right. But i know they are probably expecting me to feel this way and back out But that is not going to happen. I have everything to gain and nothing to lose. A little advice would be great. Anyone else out there had a claim succeed in the Reading County Court?

  6. 3 days to go until the deadline for LLoyds to reply to the court or make an offer etc etc. I am getting very excited, a little nervous, but more excited. It has been 8 1/2 weeks since the start of my claim (from date prelim sent) and I am looking forward to having it over and done with whatever the outcome. I have decided to take my banking elsewhere weather the settlement is in my favour or not. I've had enough of Lloyds. Will be back in 3 days to let update on any communication from Lloyds. Just wondering if it will be the bank who contact me or the court?
  7. Yesterday morning I received my court papers back from Reading County Court. Lloyds have until the 15th June to either make an offer of put in a defence. I am actually quite excited about but trying not to get too excited, just in case. Wish me luck.
  8. I am at home right this second filling in my N1. Several times today i have thought about giving up as the thought of going to court with no legal support or someone with more experience in this field is frightening me to death. I am worried if Lloyds to turn up to court and i am worried if they dont. I have no experience in this matter and have never been anywhere near a court room. I am claiming £1469 with a Lloyds loan still outstanding and with no copy of my Terms and Conditions. I have read as much as the next person on here and as much as it is very helpfull i find some of it hard to understand as i am dyslexic. I feel as though i have already lost.
  9. Thanks Tide. I have got as far as starting the court process now so wouldnt sending an SAR be too late? I suppose I have a right to the information, just worried they may drag their feet now I am about to start court action against them. I am due to submit the court papers today. Soniam
  10. Anyone else pooping their pants about the recent failure of bank charges claim?? Have read the new thread and i have to say i am. Though i am not put off. After years of receiving an unprofessional service for which they have the barefaced cheek to "charge" for, i refuse point blankly to let them win before i have had the chance to try. I hope that Lloyds dont think this is putting people off because it shouldnt. It certainly wont me. Anyone new reading my thread, read the new thread added by Bankfodder today and it should answer a few questions ( i would give the link but i dont know how ). I am about to put my court proceedings into process tomorrow and i will be keeping everyone on here posted. P.S - does anyone have a copy of their Current account Terms and Conditions they would like to share with the Forum? I no longer have mine as opened my account when i was a stroppy teen and most likely threw them out with my Jason Donavon LP. When it comes to putting my bundle together it would be handy. I am worried if i ask LTSB for them that they are likely to drag their heels. Has anyone successfully received their T&C's on request? Sonia
  11. I am, like many, very nervous now, however I am not put off. I was willing to go to the court from the very beginning. I have had my account since 1993/94 and no longer have my current account T&C's. If anyone has a copy they would be willing to share they would be very very gratefully received and helpful towards fellow LTSB claimants.
  12. This coming Tuesday it will have been 14 days since i sent my LBA to Lloyds. Honestly.....I am bricking it about the possibility of taking the the bank to court but i am not going to back down. I am wondering how much it will take me to do this though. Being a single mum, money is tight and i need to count for every penny. Does anyone have any idea how much this is likely to set me back? Thanks in advance for your comments. :idea:

  14. Louis, Thank you for your post. You made it sound much clearer as before the interest "bit" was clear as mud! I have sent my LBA via recorded delivery today including the 8% statutory interest. I included this in my prelim as per advice gained from MoneySavingExpert.com. Then yesterday joined CAG and realised after reading the FAQs etc, that doing so was a bit premature. I paniced then spoke with Bextar in the chat room and she said she had done exactly the same so all was not lost. So I continued my claim with the slightly doctored LBA template this afternoon. In regards to the o/d interest (and being slightly dyslexic) i am not sure how to work this out. I used the speardsheet provded by CAG and it gave me the exact amounts that the calculator on MSE gave me for the stat 8% (of which i have already included) this therefore confused me further more!! I have therefore decided that considering that I thought the money i have paid out in charges was gone for good and now there is a strong chance i can claim it back, i wont bother trying to claim something i dont feel competent enough to. Just the charges would do me and the 8% interest is a bonus. This adds up to just shy of 2k and that would be plenty to take me and my baby girl on holiday. Plus i have a Nationwide account and a Capital One account to claim from - so i wont be greedy. Thanks again for your help. Sonia
