I did and the figure they gave me was £390.50 the same as the total on the form from the bailiff which included this fees Local Taxation Outsanding £248.50 Statutory Levy Fee £30.00 Walking Possesion Fee £12.00 Enforcement costs £100.00 Total £390.50 I asked for a breakdown and they told me to contact the bailiffs office I told them what the Bailiffs office no was saying and they put me through to them I was them told when I asked about the fees that I would have to contact the bailiff to query them Sounds like they let them charge what they like

I have been issued a Notice of Seizure of goods and Inventory and a Form of Walking Possesion From a Merton Bailiff Services (I know I shouldn't have signed it but he turned up really early and was very loud and I was half asleep and didn't want the nieghbours to hear everything !!) The fees they are trying to Charge me are Statutory Levy Fee £30.00 Walking Possesion Fee £12.00 ENFORCEMENT COSTS £100.00 Can someone please tell me if these are correct and if not what they should be ASAP as They are about to close down for Christmas (Wish I worked there and got such long hols!) The Notice of Seizure and inventory says I "can pay either the bailiff or direct to Merton Bailiff Services at the Address above" Although there is no info reguarding them on any of the paperwork except their name is this legal? shouldn't there be something IE: address and phone Number Also how do I find out if this man is indeed a Certified Bailiff as he hasn't put his certification no on anything and the 02072100516 no wont connect Please if anyone can answer I really need this info urgently as otherwise I am going to lose my car which I need as I'm disabled Many Thanks in advance Belville

  5. Hi Pete May I ask..... Have you contacted the police about this? cause if it was me and The bank was playing me around like this then thats where I would be headed. I really think that if you haven't yet then you should ASAP. All the time you don't go to the police, the bank won't do anything except fob you off. And Also if you haven't been to the police, they probably think that you know the person who's doing this and aren't doing anything because of that. So again I say GO TO THE POLICE and report this as a possible internal bank fraud. Good luck Belville

  10. Did they make you sign anything when they did that? how much should the charges have been? Can you scan and post the letter mentioned in post #1? Is there anything in their T&C's that say that this will happen? If so could you scan and post that too Thanks Belville
  11. Ok so I have an Update on this I have today received what Capital one say is my credit agreement I'm not 100% sure that what they have sent fulfills there obligation. I have been sent the signature side of a letter that does infact have my signature in my handwritting in a box that says Credit Card Account Agreement, it is on what appears to be one side of a letter envelope there are no prescribed terms and conditions with it only a copy of the current T&Cs Also theres a copy of a screen shot regarding the default on my account and template default letters. Any one got any thoughts on this belville

I received this in responce to my letter claiming hardship 5th August 2008 Dear Shooter I am writing to let you know that we've received your Complaint and to say how sorry I am to learn that you're unhappy with us. You have my assurance that we will investigate the concerns you have raised with us - this may take a little time but we would expect our enquires to be complete within the coming 20 days. We will then be able to respond in full to your complaint and at that stage, I hope, resolve matters between us. Yours sincerely Laura Baker Customer Services Officer So they have until Tuesday am to write me regarding the charges part of my claim, If I haven't received anything in the post by then, I will be phoning Laura Baker!
  13. Unfortunately what they can and cannot do is neither here nor there as they tend to do what they like until you catch them but the short and curlies. Try sending the letter in my post above and if after that they still keep phoning you report them to the FSA, FOS and OFT as well as your local trading standards office. although I think that they will respond as they like their credit licences more than they like harrassing you. Hi beachcomber Below is a copy of the letter I sent to Cap one's Debt collection agency NCO It worked and they wrote back confirming that my phone nos had been removed from my records Dear Sir/Madam, Your ref: Thank you for your letter dated xx/xx/xxxx, the contents of which are noted. As a holder of a Consumer Credit Licence, you are obliged to comply with the Office of Fair Trading Guidelines on Debt Collection. I would therefore be obliged if you would provide me with an explanation as to why you are attempting to collect on an alleged debt which is in dispute with Capital One (Europe) plc, prior to your first contact with me, and has yet to be resolved. Office of Fair Trading guidelines Section 2.8k clearly state "not ceasing collection activity whilst investigating a reasonably queried or disputed debt." Since this is considered an unfair practice and contrary to the Office of Fair Trading guidelines, you should consider this letter as a formal complaint, and provide me with a copy of your complaint resolution procedure. I also require you to confirm that you will now comply with the Office of Fair Trading guidelines, and will not attempt any further collection activity whilst the dispute is unresolved. Should you fail to provide me with the required undertaking within 7 days, I shall report your breach of the Office of Fair Trading guidelines to Trading Standards and the Financial Ombudsman Service. Take notice that I will not discuss this matter on the telephone, and all further communication must be in writing. Any further telephone calls will be perceived as harassment, and dealt with accordingly. Any investigation undertaken by them may affect your ability to hold a consumer credit license in the future. Further, take note that continued telephone calls after the receipt of this letter may constitute a criminal offence under Section 127 of the Communications Act 2003. I will only communicate in writing; your telephone calls will not be answered. I am of the opinion that if your company continues pursuit of this alleged debt, it will be in violation of the Administration of Justice Act 1970 section 40, Protection from Harassment Act 1997 section 3 as well as breaching a number of the Office of Fair Trading Collection Guidelines. I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than merely respond with standard letters and leaflets. Hi Sempie, as far as I know you have to wait until you get the final responce letter from Lloyds before you can take your case to the FOS having said that I do believe that The FSA take retaliatory measures very seriously. make sure you keep a record of any calls you make or receive, take the name of the person you talk to and note the date and time of the call. If you don't get a satifactory responce then contact the FOS and FSA with as much detail as possible and include copies of any letters that you write or receive Good luck with this Shooter x ps. Well I'm now going after LLoyds Credit card for charges and PPI ( ppi claim details in the PPI Forum) This is the letter I am intending sending Lloyds TSB card Services PO Box 13130 Brighton BN1 4UZ Dear Sir or Madam, Re. Account number: ***************** I am writing to request that you repay all the default charges that have been applied to my account. I do not believe these charges reflect the true cost to Lloyds TSB Card Services of my making a late payment. The charges total £610.45, being £324.00 late payment charges, and £286.45 Compound contractual interest on both at 19.94% P/A and increasing by £0.16 per day. I believe I have been unlawfully deprived of the money and therefore ask that you repay me the full amount. Please find a full schedule of the charges with this document.
