  1. I see that the Data Protection Act Subject Access Request for evidence of manual intervention was a letter I was suppsosed to send at the start. My first letter was downloaded from the BBC website so is different to the templates one on CAG. It did state that 'I request without further notice a breakdown and proof of all costs involved, in regards to your actual or liquidated losses involved in any breach of contract to which these charges relate with yourselves, and that these charges reflect your true costs in relation to the said charges, and are proportionate to the charges levied on my account as defined in UTCCR 1999, Schedule 2 (e).' Is that ok do you think? Should I use this letter where i should put in the Data Protection Act Subject Access Request for evidence of manual intervention??
  2. Hi Gary I am just putting together my Statement of Evidence and Bundle and wondered if you could help: In the Bundle, SOGA 1982 doesn't seem to be in there. Could you please send me a link to this if you have one? For the Statement of Evidence: 1. Do you think it matters if I don't have any of my Automated charge notification letters? Will I need to take out the bit in the statement relating to this if I can't find them to put in? 2. The link to the Australian Default charges report, doesn't seem to work as a direct link to the report. Do youhave an updated link for this? 3. Is there a link to the Data Protection Act Subject Access Request for evidence of manual intervention? 4. Is there a link to the Transcript of radio interview with Peter McNamara, former head of personal banking, Lloyds TSB? Also do these docs need to come directly after the SAE or can I reference it to the page it is on in the bundle? (Sorry if this last question seems ridiculous, I just want to make sure everything is right!!) Any help you could give me would be greatly appreciated. I am going away for work on 16th May and my deadline for submission is 24th so I'd like to get this finished tonight or tomorrow if poss. Thanks

  6. ok. i found the link to spreadsheets and been reading through the posts a bit. i think i will claim the 8% stat interest as i mostly had an interest free overdraft on my account. in light of this, can you tell me how id calculate it? and would i calculate it until the date of my claim or until the date i send the letter? is there a template for doing the schedule or charges? im sorry if im repeating questions that you may have already answered, i thought i understood this process but im starting to feel in over my head!!

  10. thanks for your response. i think i would find it very helpful if you did post your application -thanks. im gonna try and get my court bundle together this weekend as i will be away most of next week. so do you think i will be able to send my claim for interest with my court bundle or should i try to do it earlier? despite your advice kennyh not to put in all of the docs, my order states that i need to provide all the docs i will rely on in court so i think that means a tree will die for my cause!
  11. I didn't issue it!! The Judge did. I had one prepared to send but the Judge got there before me and issued it with the notice of hearing. Is this a first? The only downside is that my deadline is a month before the court's deadline so I will probably have to send my bundle before Abbey settle. Do you have any advice as to whether I can ammend my claim to include interest where I had previously opted no to claim interest? Thanks
  12. I should add that I have already been given a hearing date and have a deadline of 2 weeks time to serve my documents as per the draft order cited on CAG. Does that not make it too late? Or can I send my ammended claim with those documents? Thanks
  13. Hi Ellie Thanks a lot for your response. I had read through those threads but I was worried that yours was an ammendment to the calculation of interest, where as I had ticked a box on my online form stating that I do not wish to claim interest. I don't know if I can go back on that. To be honest I don't really understand the difference between stat interest or contractual interest either. If you or anyone could help me on that I would be very grateful!

  15. can anyone please tell me if i can amend my claim to add interest? i opted not to claim interested when i first filed my claim. it seems now like it could add a fair bit to my claim amount and i wondered if it is too late to claim it? also does it matter that i had an interest free overdraft for a year of my claim? please help! thanks

Just to let you know that I received my hearing date from the court, with an order from the judge that i provide parts a,b,c and d from the draft order that you guys suggest and that abbey in turn has to provide a-f about its charges (including revealing their true costs). i hadnt sent an AQ as they dispensed with it and i hadnt yet requested a draft order. it seems the courts are on to this now and ordering it themselves so as to speed up the process. the only downside to the court ordering it rather than myself is that my deadline for submission is a month before the courts, so i will have definitely have to send my papers off instead of waiting to see if abbey settle first (although i will still write to them to give them the option to settle -at least so that the court can see that i tried). has this happened to anyone else? i know you have various links to documents a,b,c and d which should be included in the bundle but, while everyone else has trouble understaning c and d, i am confused by a. 'in a schedule under the headings 'date', 'amount' and 'description' give details of each item in respect of which a refund is sought'. is that literally just copying my statement out? what do i put under description? would that be the description the bank gives for the charge? i guess with c and d i can just use the docs you give us? will i need to add anything else to either of those? thanks!
  19. Thanks again. If i send a request for standard disclosure do i have to do it in the form of a draft order or can i just write it in a letter? I am goin to send the court copies of the statements anyway. Should i cc the bank? Thanks

My bank (Abbey) has filed a defence in respect to my claim (£456) and I recently received a letter saying that my claim has been transferred to my local court. The bit about the allocation questionnaire was crossed out and thus no questionnaire was enclosed. So what now? Is it worth me writing a letter to the judge requesting that he/she order standard disclosure? Can I make this request without an AQ? I have read that an AQ usually comes with a fee so if I send a letter making the same request, but without enclosing a fee, would they accept it? What happens if the judge throws out the case instead of giving me a court date? Thanks!!
