  3. Hi Ethel, I have a solicitor working with us . The land registry told me we should file an objection to any further changes and an objection to removing mother in 2016 . I was hoping that there may be a solicitor on here who could point me in the right direction . I will give my insurance a ring and see if they can advise re wording etc . I have used this group lots for advise but agree I will get legal help too Thanks
  4. Hi, not sure if anyone can help . My Mum died in 2003 leaving her share of the home to myself and my sister . Her will also allowed my step father to live in the house until he died . He moved in with his girlfriend three months after Mum was buried . My sister and I were not advised of our legal rights . He died a couple of weeks ago - we do not have good relations with step siblings . It appears that in 2016 he applied to have Mum removed from title deeds - she did have a beneficial interest - I think my sister and I should have been added after her death but as we had to get the will through probate there was no help . I have to write an objection to anything else being changed on the deeds - there is a restriction in B that if its removed will be very detrimental to my sister and I . Can anyone help me with the legal wording or where to find it please? Thanks
  5. Hi, I haven't been here for some time . I need some help . I had my dishwasher insured with domestic and general , mid-September it started blowing fuses in the house , with a bit of a fight they replaced the machine at the end of September with a Hotpoint . 

    All was good until 23.12.22, the machine stopped taking on water . Hotpoint were not open until the 28.12.22. They booked an engineer for 03.01.23 he was unable to fix it and ordered parts. On 09.01.23 another engineer came , couldn't fix it and said it needed two ECU's. Hotpoint have now said they can't get the parts . Rather than offering exchange or refund ( so we can get a machine that isn't HOTPOINT)  I am being told just to wait . How long is appropriate for a machine three months old ? I have tried quoting the consumer rights act 2015 at them and they couldn't care less .

    Any advice / letters etc would be most greatful.

  6. I sent them the SB letter from here recorded delivery. They just wrote saying they are offering me the chance to pay 70%. I won't. If they keep writing I will report them, not much good that does.
  7. Received letter from Cabot saying they still hadn't got the cca so standing order cancelled. Ruthbridge still writing despite my sending them statute barred letter. The debt was, an overdraft but I believe its covered. Chucking letter in a corner never to be looked at again. Thanks for the advice
  8. The advice was, 15 years ago that if a true signed copy of the CCA was produced then you carried on paying. That's why we did. Advice also to send Section 10 dispute letter etc The CCA had husbands signature on it and his handwritten date - all letters to Cabot did not include this. My worry is if they get it again and we just stop paying we risk court etc, though I suppose it makes no difference now.
  9. At the time all advice was that if the DCA had a true signed copy of CCA then it was enforceable. I got that from here.
  10. Who - Cabot produced CCA true signed copy in 2008/9. We - had to pay They - threaten CCJ We- request CCA again in the hope they can't produce it now. They - send letter asking for income expenditure. We- ignore it What - now they say they need more time to get it. I can't just stop paying surely?
  11. Thing is they were able to get one which is, why it's the only debt we didn't put in dispute. I suppose that's why we are concerned now as they could produce another one from somewhere. I spent years trying to sort it all out and most are SB. I will just send them an f off letter.

  13. Thank you all for your support . SB letter ready to send to Cabot/Ruthbridge same letter , same envelope . We received two more letters re husband - 1. we dont have the CCA but are contacting original lender give us more time. Today - we love you and are here to help , here fill out this income and expenditure form , if you're not happy then complain . so about to do the No CCA Section 10 dispute letter and cancelled DD . Oh we do love a good fight . Thank you all so much .
  14. Yes, we sent the first one in 2009 and had the same "we don't have it but will get it" they then produced a true signed copy of the original from RBS. We sent another mid Sept and received the same letter. I am now thinking that if they don't have it themselves we should be able to put it into dispute...
  15. Sorry, just a quick one. My hb debt with RBS is personal. Cabot have responded that they do not have the CCA so need to go back to original lender. 10 years ago we asked the same and they did present eventually the original CCA via RBS, hence the pound a month. Could we place the debt in dispute as they obviously don't own it. But scared to just stop paying. We can do without Northampton charges right now.

  17. Hi London 1971, Husbands debt is for £29k - it was given him for our now very defunct business by RBS. We have asked for the CCA before in 2010 and I think they got it which is why they have had the pound a month. They wrote again saying that they received our request for CCA and were getting it from RBS, I am hoping that 13 years later they have not got it . Tempted to put it in dispute . Regarding the other SB debt - how on earth CABOT picked it up I don't know that's for £3k an overdraft but I already spent five years fighting MARLIN re that and they agreed it was SB .
  18. Hello, My husband had a debt with RBS which was sent to Cabot around 14 years ago, it's dates from 2004/5. For 13 years he has paid a pound a month. Suddenly, they are writing threatening him with CCJs etc. We have, written again asking for the true signed copy of the CCA. The response was firstly to send another threatening letter and then to say they are, trying to get hold of the CCA. At which point would we put this into dispute finally. Secondly, all of my debts are now SB but I received a letter from CABOT (never had anything from them before) informing me an overdraft from an account that went into dispute 11 years ago and was SB in 2009 has been passed to Ruthbridge. I am tempted to send a statute barred letter and tell them politely where to go, would this be the correct course of action.? Thank you for any advice.
  19. Hi, my new boss has been trying to cause me difficulties since she started in September. Most recently she tried to give me a formal verbal warning for thinking out loud. My union sorted it and yesterday it became informal. Then three hours later I was asked to the big boss office. I was informed I was being disciplined for gross misconduct based on a letter that was full of lies. This upset me greatly because I haven't done any of the things I have been accused of, the letter even states it isn't a complaint, isn't dated and isn't signed. I have grievances I need to submit over bullying and harassment and the way these last two events have happened. I don't think they have followed Acas guidelines as it suggests the investigatory meeting should be before they decide on the conduct, then it's the disciplinary. They have already decided I am guilty even though I haven't done any of the things I have been accused of. I have a number of chronic illnesses covered under the equalities act 2010 and the stress has made me very ill. They don't like that fact and trying to punish me. It isn't safe there anymore so I am getting signed off sick before I end up in hospital. Can anyone direct me to grievance templates please or offer any advice? Thank you
  20. Your previous posts detailed exactly what I should put in. I did that. I requested full details of the event and manes, Caldicot etc the advice is in a previous reply. I virtually copied your post into my letter so you know what was in the letter because you told me what to put on. There is no need to be so offhand. I have followed the advice that you so kindly gave and while those questions were answered they have refused the FOI and I still waiting for the SAR. I have been offered a face to face meeting.
  21. I followed the advice from previous posts, so no information was actually given as it would breach their data! Oh the irony. I will get on to the ICO. Had no response at all re the SAR has either.
  22. I really want an apology and some form of compensation, though I haven't directly requested that. Now my letter etc has been passed to a complaints depot. I received a letter answering my questions refusing FOI because that would have effected their data protection. Basically told that despite the original letter stating it was my entire record now it is apparently not. I had an exercise referral and I self referred for counselling - the reasons are private and even my doctor who referred didn't know. It is that information that was shared and was told 'it isn't much' I informed them that that was confidential and should only have been shared if necessary to another medical professional and I wasn't happy with the response. Still waiting....
  23. Thank you, I am working on catastrophising the events and will attempt to see the gp if the panic continues. My files were emailed to people working in an IT firm they were sent apparently mistakenly. So while they probably have done nothing it is highly unlikely they would have undergone the stringent checks those actually working for the trust would have. Writing my letter now.
