  1. hiya thanks for the advice. i just wanted to know the likelihood of mbna seeing this through to the end. i dont really want to go to court again, been through it with loydstsb (case stayed). is there a template for the next next letters to send? regards, yuenyi.
  2. hi just received my s.a.r request back from mbna, saying they dont agree with the oft report and that their charges are fair blah blah blah. Have offered me £520 from a possible £1134. they said i will get the cheque in the next 10 working days. should i wait for the cheque, cash it then ask for the rest or should i just ask for the entire total straight away? need some advice urgently as i, not sure which steps to take next. regards, yuenyi

  4. Hi i was wondering if someone can help me. I had a NatWest credit card in 2002, which i defaulted on in 2004 which i subsequently settled the balance and closed the account. I have just recently tried to contact NatWest about the information regarding the credit card account as i am looking to reclaim the charges back but they said that they no longer had any information regarding this account as they only keep the files on record for 6 months. Is there anything i can do to get this information or is it lost forever??? regards, yuenyi

Hi all, i have just recently paid off my mbna platinum card but i have paid a hell of a lot of charges over the years. can someone advise me what charges i can claim for and is it the same process as claiming from a bank account? I defaulted on the card around about 2003/04 so is there anything i can do about this and will it affect my chances of claiming? I have been reading a lot on the mbna thread and theres a lot about sca's, cca's, sar's im a little confused about what these are. if someone can offer some helpful tips on what to do first i would be eternally grateful.   8. hi mate, i have a court date for the 27th of July at Bristol County Court and i need to send the relevant documents before the 13th. Im not sure if its the final hearing but ive been sent the notice of allocation to the small claims track (hearing) and it says the judge has considered the statements and allocation questionaires filed and allocated the claim to the small claims track. It says each party must file with the court and serve on lloydsTSB his/her own signed witness statement in support/defence of his/her claim. Is there a template u can give me for how to write the witness statement and is there anything else i should send? Also i need to make an ammendment to the amount of my claim as i incorrectly calculated the interest charges. The new sum is £3.213.52. It was originally just over £4000. Do i need to inform the court of this? Also i had a letter from lloyds solicitors a couple of weeks ago saying they wanted to settle (without admitting liability) the claim, but there were discrepancies in the figure i was claiming. I have since sent them the revised total in my spreadsheet listing every charge, date and interest as requested by them by fax and post but as of yet have not had a reply. Do u think this is a delaying tactic? or do u think i should wait for their reply before submitting my documents? Im getting a little nervous now so any nudge in the right direction so that i am successful will be greatly appreciated on a personal level and if i am successful with my claim a very generous donation to the site for all the hard work you guys do will be forthcoming. Notice of Allocation to the small claims Track (hearing) District Judge Rowe has considered the statements of the case and allocation questionnaires files and allocated the claim to the small claims track. The hearing of the claim will take place at 10.30 on the 27 july 2007 at bristol county court and shall take no longer than 5 minutes. The court must be informed immediately if the case is settled by agreement before the hearing date. Each party shall deliver to every other party and to the court office copies of all documents (including any experts' report) on which he intends to rely at the hearing no later than 14 days before the hearing. The original documents shall be brought to the hearing. Each party MUST file with the court and serve on their oponent his/her sihned witness statement/s in support/defence of his/her claim at least 14 days before the date of the hearing. Witness statements includes the parties to the claim in addition to other persons. Notes for guidance on the making of a witness statement It must not be a bundle of relevant documents It should set out the relevant facts It should be an account of what happened in the order in which it happened If you are in any doubt what to say in it, imagine you are writing a letter to a friend telling them about the events It should then attach any relevant documents and identify them as the narrative proceeds by words such as "see document number 1 in the attached bundle. If a document has more than one page it is helpful to refer to the relevant page of that document It should be in the words of the witness whose statement it is If that witness is not going to give oral evidence at the hearing and the statement is to be used at the hearing in written form only, you should explain that to the court and the other party when thr statement is filed with the court and sent to the other party. It wil be helpful if you explain at the end of the statement after the narrative what you consider you are entitled to and why.
  10. Hi everybody, i have a court date for the 27th of july so i must submit all my documents before thr 13th. Ive been reading all i can on the website but im still a little confused. I have been send a notice of allocation to the small claims track (hearing) by Bristol County court. Now am i right in thinking this isn't the full blown court proceedings? and that i only need to include a basic bundle or am i way off the mark? In the notes section of the form sent to me it says 'it must not be a bundle of relevant documents' so im a little confused about this. So can someone give me a link to show me exactly what needs to be included if it is to be a basic bundle? Also i have been reading about people submitting their AQ, now im a little worried i might have missed something. Should i have submitting my AQ by now? or will i have to do so when i submit my other documents? I dont recall there ever being a mention of an AQ in any of the correspondance i have so far received from the court. Finally, i need to make an ammendment to the amount i am claiming, its a little bit less than i originally claimed for when i started court proceedings. Someone mentioned to me that i need to submit an A44-something form i think, which will cost £35. But i remember reading a post somewhere where it said i dont need to. if someone can please clear this up for me whether i do or dont need to submit this i would be eternally grateful and advise me how i can get hold of this form if i do need it.   11. Hi guys ive been reading all the threads on the lloyds forum and i have a court date for the 27th of July which means i have to submit my domuments on or before the 13th. Now im a bit confused as to what i need to send in. Do i need to send in my full bundle now? it says that i need a signed witness statement which i must serve with the court in support defence of my claim. Is there anything else i need? Also ive been reading about people submiting their allocation questionnaire. At no point can i remember anyone asking this of me. Have i missed something out? is it very important that i submit this? Am i right in thinking i dont need to submit the full bundle just a basic one because its only its just the 'Notice of allocation ot the small claims track (hearing)? I was wondering if anyone can help me i need some urgent advice as I have been sent the Notice of Allocation to the small claims track (hearing) form from the court. I have a court date set for 27th July 2007. Now the original figure i have claimed for was over £4000, but i realised i incorrectly calculated the interest figures and the actual amount is only £3,213.52. Do i need to inform the court of the change in the amount i am claiming? And will it affect my chances of the claim being successfull??? Also i received a letter from Lloyds Solicitors a couple of weeks ago, saying they wanted to settle the claim but that there were discrepancies in the figure i was claiming.
