Okay, what I will send is this e-mail to Rachel at DG today and the acceptance letter signed plus a cover letter with the same content below:- DG Solicitors 12 Calthorpe road Edgbaston Birmingham B15 1QZ Date 10/07/2007 Dear Rachel Ref: Your Offer of Settlement Account: 31062697 Sort Code 40-02-35 Claim No: 7QZ52269 in Brentford County Court I acknowledge receipt of your letter dated 9th July 2007 and your settlement offer of £1,520.00 *I accept your offer as full and final settlement only for this claim of bank charges made on my account between 14th March 2001 and 11th January 2007 I accept this offer without prejudice and I reserve the right to make any further claims should you apply future charges that may be considered unlawful under common law or in violation of the Unfair Terms in Consumer Contracts Regulations 1999 or Unfair Contract Terms Act 1977. I will be willing to withdraw my claim upon receipt of unconditional full settlement of my claim. I am also not prepared to agree to any confidentially clauses you try to impose, unless of course your client wishes to make an offer of due consideration in addition to the amount of £ 1,520.00, in order to be afforded this privilege by myself. I trust that you will find this arrangement acceptable. Yours Sincerely

Thanks for the example e-mail, will send today but just a couple of queries:- Are you saying to NOT include the statement in Celicaman's example e-mail or don't forget to add the statement, I am also not prepared to agree to any confidentially clauses you try to impose, also what does this statement actually mean unless of course your client wishes to make an offer of due consideration in addition to the amount of £5,000(I assume this figure would be min £1520), in order to be afforded this privilege by myself. Thks

Well, guys, today, as pete mentioned, a white envelope appeared from DG, and although it had no cheque in it, it has offered me the amount I requested £1520(even though the letter still states the Charges are reasonable, and properly and fully disclosed in its T&C's and that HSBC are confident that they are entitled to apply these charges and that it would successfully resist my claim in court. It also says, 'But mindful of the management time .......etc, without any admission of liabilty, HSBC are prepared to make an ex gratia payment of £1520 for full settlement. By accepting this payment you agree not to make any further claims on the charges for the period and to treat as confidential. If you accept this proposal(which I will), sign and return the enclosed copy of the letter within 7days and we will arrange a refund. So result, but won't celebrate until dosh in account.   8. Okay, one week to go before the court date(16th July 2007). Court bundle sent and received by Court(Confirmed) Court bundle sent again via Recorded delivery to DG. Royal Mail confirmed delivered okay. Various e-mails, msgs left for DG to advise of this but surprise surprise I have not heard from them once in this whole. Anyway, are there any last things I need to prepare for the court date and\or things I need to be prepared to say if reqd. Thanks again
  9. Thanks for this..makes sense now. This is the e-mail I was going to send to all 4 of the HSBC contacts mentioned. Is this okay? Dear Sir\Madam, I have been trying to contact you but have had little success. I have sent numerous letters to the DG office but have not had any response to any of these. This e-mail is to remind you that the Court Hearing date is set for the 16th July 2007 and I have therefore sent a copy of all the documents that I intend to rely on in court, to Brentford County Court and DG Solicitors on the 26th June 2007. The court have confirmed they have received these documents and this e-mail is to ask if you could also confirm reciept of these documents. If I do not hear from you by the 4th July 2007, I will resend the documents again. I would appreciate though if you could confirm receipt of the above. Also, can you please forward a copy of the documents you intend to rely on in court? Many regards

  12. Tried calling DG but just recorded message advising to speak to court re: case against HSBC or send a letter. I don't not have an e-mail for them on the address and Tel #0121 455 2701. They have never responded anyway to any of my letters\messaged(when I could leave one), so don't expect any change there. Do you have an e-mail for them, I could then leave it a few days and if no response, copy the bundle again(don't really want to waste more trees than I have to), and send again.

  14. Do you think I should send the letter recorded delivery plus the bundle again. Just a bit worried now as you say 'lets hope they don't sink that low'.
  15. No, I sent the first class. Hope that is okay. Will call Court to check they have received it. I didn't actually have a Court directions as mentioned ina previous post, just was recommended to send the bundle anyway, even though it was not asked for.

Guys, As I didn't send the a note with the Court Bundle to DG stating 'please find enclosed a copy of the documents that I intend to rely in court' I thought I would mention this in a further and possibly last nudge letter this week, see text in red. What do you think of this letter, appreciate your comments.. I have written to you three times in the past, asking for you to consider my claim and reply to me. I have heard nothing. Were this to come before a judge, it would be obvious who has made any attempts at resolution. It is my feeling that you seem to have no intention of defending this claim in court and are simply procrastinating. I am mindful of the vast number of claims with which you are currently dealing. In order to more speedily resolve this matter, I am willing to accept the sum of £1,520 as full and final settlement of this particular claim. I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality. On the 26th June 2007, I have sent all the documents that I intend to rely in court to Brentford County Court and sent a copy of the same documents to yourselves at the same time.   21. Thanks, and is this part of the statement of evidence or should I call it something else on the Index. Fortunately, the SOE and Litigation takes up the 5 pages I removed by taking out the HSBC without predudice letter' so only a qtr of the pages have to be re-numbered.
