  1. I agree Trucker, this being round two I have rather a lot of charges repoated paperwork! Statements arrived this morning. Barclays are not an eco freindly Bank, I asked for the last 8 months starements - they sent me 6 years! On to the next stage - calculating what they owe me. Smashing. BAT
  2. Yep. Dino is the man. He was polite and courteous (as was I;)) and most importantly he was blinkin' efficient. I sent him a fax accepting the offer and the money was in my account the next day. Cheers Dino.
  3. Well surprise surprise no news from barclays as yet. 40 days nearly up. on to the next stage soon.
  4. Dude what haapened - did you make it to court, what was the result; here's hoping it was positive for you. BAT
  5. p.s. in case you haven't seen this: http://www.consumeractiongroup.co.uk/forum/nationwide/90366-have-banks-just-case.html regarding the lloyds case - makes for interesting (and useful) reading
  6. have you read the guidance on actually going to court? http://www.consumeractiongroup.co.uk/forum/guidance-notes/641-case-guidance-notes-going.html
  7. I take it you've read this?: http://www.consumeractiongroup.co.uk/forum/guidance-notes/641-case-guidance-notes-going.html
  8. Beaky, looks like a standard defence to me - certainly points one and two were on the defence papers on my last claim. BAT
  9. Hiya, I can understand you getting nervous, most upright decent citizens have never been before a judge. You can calm your nerves by doing some more reading, make sure you are totally up to speed with the arguments which you can find on this site. Second, don't contact the bank until one week before court, they've got enough on their plate and probably won't want to talk to you. Any way I'd be surprised if you don't get a letter/phone call in the next few days. Third, if ( and it's a very big if (IF)see, told you ;-)) you get to court they don't expect you to be a legal expert. Just be polite answer the questions honestly and you'll be cool. We're with you all the way. BAT
  10. Hello mate, you've got a way off to worry just yet. remember that todays case doesn't set a precedent and by the sounds of it there'll be an appeal. My gut feeling is that Barclays still won't take it that far and you should get a letter/phone call making an offer. That said you shouldn't rest on your laurels. make sure you done everything recommended here: http://www.consumeractiongroup.co.uk/forum/guidance-notes/64911-got-court-date-guide.html#post553523 No doubt there will also be a few (much more experienced than me) out there with more advice for you. BAT.
  11. Hi again all. Round two begins today for the charges barclays made to my account from the date where my last claim finished. It's only from November last year to now and not much in value I reckon, but as we've heard so many times before on this site - It's my money and I want it back. SAR sent today. BAT
  12. I've been away for a bit again so sorry for the delayed update Got a letter from barclays offering a settlement not far off the full monty - I rang them haggled a bit and when it came to discussions of court they caved and coughed up. Money hit my account this week and I've just contacted the court to let them know I've settled. Can a mod change this thread to *WON* please! In between times I've incurred a couple of extra charges so on to round two! Thanks to all for help and most of all support. Without you guys I'd not have had the cahoonas to go on this far. I've spent the last three moths raving about CAG and putting everyone I know on to this. RECLAIM THE RIGHT! BAT
  13. Thanks Dar3n. I've four questions relating to the allocation. My claim is for just under £5k. However, interest will take it above. Will this weaken my case for small claims? Should i have received a copy of Barclays AQ? If it does get allocated to Fast track what are the advantages / disadvantages? Is it worth me contacting Adrian at Barclays to discuss settlement? Many thanks. BAT
  14. Hi again all, I've been pondering my predicament. As this is an allocation hearing and the usual route in is small claims - should i be arguing particularly for small claims or should I not really be bothered which the case is allocated to. I had stated small claims in my AQ - now I'm not so sure. Thanks in advance for advice. BAT
  15. Cheers BB, If the Mods are ok with that I will do. I did notice that multiple thread are frowned upon. BAT. P.S. It's Bedford 17th May 11 am.
