  2. My mums doing the race for life in Derby on the 10th May 2008. She's doing it in memory of a friend who died from cancer lastyear and is really unfit but determined to reach the finish line.   3. Hi Nickismee Firstly Natwest can be a right pain at times I've been dealing with them for the past two years. B.T. also offers a service for home phones called choose to refuse it's free for the first month and most companies stop calling by that time. Also there's a really friendly and helpful forum just for people having problems with Natwest and that's here :Click here: NatWest Bank - The Consumer Forums I'm afraid to say that if the account that your sister has her wages paid into is in your name and you owe Natwest money then sooner or later they will take the money The best idea is if you can have her wages paid in somewhere else until this dispute is sorted.

  5. Hi Pink Lot's of people on the thread are having trouble with Littlewoods ( me included ). Mr marmite that's how it should work in theory but Littlewoods and the CRA's are not playing ball. I've complained to the Information commissioners office about the same thing and the FOS. Good luck pink and keep us posted on how you get on.

Received another letter from the FOS yesterday explaining that my case has been given to an adviser and that if they need anymore information they will be in touch ( the letter also stated that this type of complaint can sometimes take six - nine months to resolve ) So I can put my feet up for a while with this one and will hopefully hear something when the warm weather finally arrives......roll on summer and barbeques in the garden:)

  9. Alf I just read your whole thread again ( wipes brow as steam comes out my ears ) Look at posts 48 & 65 seems suprise went down the FOS route and got back some of her service charges. Might be worth having a quick read again.
  10. Keep me posted DP I've complained to Littlewoods, experian and FOS and am waiting too but FOS say it could take up to nine months. I've included all the points you are complaining about too apart from the PPI.

I think you can pat yourself on the back Alf and add that to your bow:D Even though you haven't had the money in your hand it's reduced the balance a great deal and is more than a weeks wages to some people! I understand your point above about no agreement so therefore interest being unlawful too and actually it is.The problem with the interest though is that you can only reclaim a percentage of it ( I've seen this in the bank Forum lots ) you can reclaim the parts that have been applied due to the charges being added - meaning if the charges weren't added the interest you would and should have paid would have been a lower amount. It's very mathematical and gives me a head ache:D Studio will always argue that because you chose to pay in installments then whether you signed an agreement or not you used the account as a credit facility so interest from their part is allowed.
  12. Thanks DPick out of interest do they still update your credit file? and did you ever try and get the defaults they previously registered removed? I'm not planning on buying a mansion or a yacht but it makes me seeth that this bunch of **** can keep using your own data against you. Out of all the creditors I've taken on these have annoyed me the most! I'm personally not bothered that the default will stay on my file but what annoys me the most is this bunch's line that they won't pursue then they send your personal details to every Tom, Dick and Harry.

  14. Hi tgb, I know this might sound silly but I have dealt with Moorcroft in the past and they can be rude,obnoxious and greedy...have you CCA'd them to see if they can legally enforce the debt? ( if this is a catalogue debt, etc you might not have signed a consumer credit agreement and if you didn't sign anything they can't pursue the debt or if they can't supply a true copy they can't legally enforce it either ) Is the debt made up of lots of late payments fees, admin charges etc? you might be able to claim these back. Don't let them bully you or intimidate you so well done for terminating the call Just a few things to think about but things that could greatly reduce what's owed.
  15. Hi Teletubby I wouldn't deal with them at all now and think the best thing to do would be to make a complaint to your local Trading standards. You've had the common sense not to believe them and to get a copy of your credit file which was a good idea!

  17. The way I see it is that neither Studio nor Rob's have a valid CCA so they cannot enforce the debt whatever you decide to do now. You can now argue that the amount you were defaulted for was incorrect because it was made up of unfair charges and ask for the default to be removed. I'd report them to TS now for the way that Robs have tried to collect a debt that is unenforcable and in serious dispute.
  18. oooooo sorry Alf so they've offered you back your admin charges and interest which is a good result by greatly reducing the balance. Do you know exactly what the amount of charges applied by Rob's is and will this clear the balance? They shouldn't have been dealing with this anyhow as the account was in a serious dispute but thats what these critters are like!

  20. I went for admin charges and late payment fee's. I was told that the service charges were just for a service and were unclaimable but at the same time as I issued my claim another lady on the forum went for service charges and was awarded them aswell. So it's totally up to you:)

  22. Hi Again Alf My figures were similar and I was getting nowhere down the no CCA route so I added up the charges and applied the 8% interest at LBA stage. I found that after interest had been added it showed that Studio actually owed me money. I decided this was the best way to get rid of the debt and leave the slate clean so to speak with a little money left over for myself. Studio seem to roll over quite easily to charges claims mine was settled within 2 weeks of my LBA and I didn't have to go anywhere near a court. I know quite a few other people on here who have had the same response. I'll forward you the link to the spreadsheets section and just add up the charges with interest and see if it overtakes the balance owed. If it does I'd go down that route but if it doesn't I'd just pursue the route of no CCA.

  24. Thanks Muchly My head was zooming lastnight after reading all the arguments about CCA's and whether they were valid or not so that settles it!! OOoooo what a weight off my noggin:) The charges far out weigh what's owed anyway and it's always nice to get them back and make a clean slate....Thanks you're a God send
