  1. Mazza, Sorry for the hijack. Pat69 - anybody actually recieved a cheque from b,s without hassle?? Yes I did, luckily, but I think it's got much worse since then. I was lucky to get a short- notice hearing and the Lit'n Team sorted me out V quick - see here - http://www.consumeractiongroup.co.uk/forum/barclays-bank/70074-slick-barclays-business.html However, recently things have got much worse and I'm with Dar£n on this. I'm not defending B's but you have to recognise the huge volume of cases they're trying to d/w and the problems this is causing them. The result - they surely have to prioritise so they ignore emails and phones and try to shift cases off their desks before the Court dates. Lit'n agree to settle but then pass on the buck to the peeps responsible for putting money back in our a/c's. The money will come through but with delays. And they are now settling far closer to Court dates (or after!). Keep at it and good luck, Slick

John1422, Make sure you print out up to date SOC 1st thing Monday and add on Court Fees and anything else you want so YOU can tell HIM what the settlement figure needs to be if he wants to avoid going to Court. My contact with the Lit'n team was very pleasant. It only seems to be Paul Quinn who is lacking in diplomacy so don't be at all intimidated. Good luck, Slick

Hi Rach Vicky If you want to amend (increase) the amount of your claim, you have to apply to the Court using form N244 - see here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/41901-form-n244-application-notice.html. There is a fee involved (not reclaimable), perhaps £35 or £65. So you need to decide if it's worth it for the amount extra you want to claim. Slick

  6. Mazza, Let us know what the Directions Order says when you get it from Court. My own case was "postponed" for 8 weeks to allow B's to settle (which they did promptly) but I could go back before at any time to ask for Judgement against B's if they failed to pay. TH is taking the Mick saying it could be another 2 weeks. Have they all just lost it at Lit'n? Good luck, Slick

  10. Hi Crowe, Make the amendments, initial them, take copy for your file and send back to B's. Don't stop your claim until you've got the money in your a/c and tell B's you'll Discontinue ONLY when you have cleared funds. Slick

  13. Hi Dickeggsy, B's changed their business state's at end of 2002. Till then the state's showed a breakdown of all the "Commission" chgs separately so you can see what is reclaimable and what is normal a/c chgs. From 2003 on, the entry is simply "Comm'n Chgs for the period". So for later years you need the Advance Notification, which Jaym refers to, to see what of the total Comm'n is reclaimable. Are you working from original state's or copies from bank. Also, watch out for Unpaid Fee, Unpaid Out which show only on state's when something is bounced. Slick

  15. Hi Kats, Ignore TH and his views. Did he say why money had been delayed or, more importantly, when it was/will be paid. Write to Court and confirm B's have failed to pay as agreed so can judge please now reconsider your claim and enter Judgement against B's.   17. Hi Cluedup, Barclays may send in their AQ late and STILL get it accepted. Maybe wait till next week then speak again to the Court. It's then up to the judge to reconsider in light of B's failure to comply but you could ask for their Defence to be struck out. Wait first though to see if the B's AQ gets filed. Slick
  18. BBCH, Them settling someone else's claim like you say is annoying but won't help you right now as they are d/w with earlier cases first and I think they have so many, they're barely coping. Slick

  20. Ring the Court and ask them to send you a copy of B's Defence. You could also ask when your claim will be going back before the Judge. Slick
  21. Hi Kats, Speak to Court as you say to see what they suggest. I'd leave it till the end of the week and then,if still no dosh,.... Write to the Court saying Barclays have failed to honour their Settlement Offer and would the Court please now reconsider your Claim and make a Final Judgement in your favour in the amount of (XXXX.XX) enclosing your updated SOC and summary of Court Fees.   22. BBCH, With your Court date mid August, they're unlikely to settle for another 2-3 weeks.   23. Hi Lushni, B's have reputation for d/w cases close to or even after the deadlines and the Courts let them do it. Do nothing just now and see if they Acknowledge late and then Defend by 28th July. They will usually Defend so it's too early to get excited, but keep us posted. Slick
