Please bear in mind that banks also read these sites so if we all start to waiver & panic, or give that impression, they will try harder and be even more obstructive if that's possible. A lot more needs to come out about this case and hopefully an appeal. The lesson seems to be that in the absence of the bank mr berwick should have asked for an adjournment or even asked for the defence to be dismissed as the bank were contemptuous

Well here we go!!! I first heard about the illegality of these charges through martin lewis's site moneysavingexpert.com and became more interested. Picked up information on this site from the weekend daily mail. I have started action with 2 HSBC bank accounts an hsbc gold card (who will be getting a court action letter in the post). Claims are at various stages with liverpool victoria, barclaycard, virgin, mbna visa, capital one and the partnership store card a total of 9 claims. I can't give a total amount as I am still waiting for 40 day responses from most of them. hsbc have been the fastest to respond providing statements and the gold card part have also responded with the "our charges are fair rubbish so get lost" (including interest I am only reclaiming £67.23. It would be cheaper for them to settle) I hope they don't I would luv to send in the ballifs. I have also had a delaying tactic from liverpool victoria who required me to fill in a data disclosure request form only after trying to charge me £3 per statement a phone call to point out their responsibility under data protection produced an almost panicky call back to say the details I required would follow at no charge.
