  2. Hi wolvesfc12, MCOL is really starightforward. make sure you get the particulars of claim wording from this site, put in your own figures, check for any typos and send off. You will then get a 'notice of issue' from the court within a few days which informs you of the date of service (when the bank is deemed to have received it). You should now send 2 copies of your schedule of claim to the court for inclusion with your online claim. The bank now have 14 days to respond from date of service. In my case they filed an acknowledgement stating that they were defending the claim, this gives them 28 days from date of service. You should then receive a 'notice of acknowledgement', if this is the case you need to send another schedule of charges to their legal representative as stated on page 2 of this document. Next just wait and read up on taking your case to court. I shall seek out a link which has been pastred previously which sets out the above. Good luck
  3. Hi, I am in the same place as hannah8686, I filed around the same date and the halifax acknowledged a few days later, but nothing since. I check my account daily but nothing yet. I have started reading up on what happens if I do have to attend court, just in case! But I ma sure it wont come to that. Good luck

  5. Still nothing, maybe tomorrow as I've read somewhere on this site that if they pay they usually pay on a Wednesday. Not sure how true that is, but if its not tomorrow the there's always next week!!
  6. I would ignore what they are saying and just stick to the guidelines and timescales set out on this site. If you've already sent the LBA, then your next step is court proceedings. I used MCOL and filed my claim on 16th April, from which time they have 28 days to respond. I have also issued the same against Natwest and LTSB. Stick with it, seems they are beginning to get tougher to crack, but at the end of the day what have you got ot lose?? And besides, you will get all the support you need through this site!!   9. Received Notice of Acknowledgement from Natwest this morning, just printed my letter and schedule of charges to send to their litigation department in London. Still nothing from the halifax.
  10. Moved on a bit form this stage, eventually got all the info requested. MCOL filed 26th April, not yet acknowledged.
  11. Pigbag, The form you have at the moment is the Notice of Issue, you should get the other form as soon as halifax acknowledge. Probably a few more days?

Hi all, Managed to locate the thread with the template letters for sending the schedules, sorry not sure how to provide a link to it but its titled 'getting MCOL right' by Michael Browne After You Have Issued Your Claim Your POC's state that you will be supplying a schedule of charges, but MCOL does not allow you to attach it to your claim at the time of filing. So, once you have filed your claim, you need to send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to: Quote: The Court Manager, Money Claim Online Northampton County Court 21-27 St. Katharine's Street Northampton NN1 2LH Dear Sir/Madam (Your Name) –v- (Bank) Claim No: ******** Date Issued: xx/xx/xx Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT). I respectfully request that the enclosed schedule should be attached to the particulars of my claim. Yours sincerely, Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim. Their name and address will be on page 2. Quote: Dear Sir, (Your Name) -v- (Bank) Claim No: ******** Date Issued: xx/xx/xx Please find enclosed a copy of my schedule of charges relating to the above claim. (If, and only if, you are claiming overdraft interest on your penalties, also include this paragraph) I understand you have a policy of initially rejecting claims for overdraft interest. However, should this be the case after you have reviewed my claim, you should be aware that my claim for overdraft interest has been meticulously calculated and double checked. It only ever relates to the cumulative charges within the overdrawn balance of the account at the point that the overdraft interest was debited If it is that in your view the interest is not claimable, I am prepared to discuss this with yourseves and the judge in court.   14. If they choose to acknowledge, which gives them 28 days from date of issue, then you will receive in the post a Notice of Acknowledgement which will state the contact details. You should however, receive a Notice of Issue first from the court.

Hi pigbag, You should send 2 copies of the schedule of charges, the spreadsheet you sent to the halifax with your prelim letter, to the Court at Northampton and one copy to the legal person whos details you will find on page 2 of the Notice of Acknowledgement. There is a post on here somewhere which provides a template letter for both. Good luck
  16. Hi Hannah and Jowalshy, my MCOL was domne around the same time and I haven't heard anything yet. Check my account daily in the hope that they have reimbursed me my £1,500, but no such luck YET! Stick with it and good luck to you both
  17. Hi, My MCOL to halifax was issued on 16th April and acknowledged on 21st, they have 28days to defend themselves or pay up! I was a bit freaked out when they ticked the 'intend to defend' box! After reading more threads on this wonderful site I am more confident aboyut the possibility of going to court to get what is mine back! Stick with it,
  18. Hi all, I filed my claim on MCOL on 16th April, halifax have acknowledged which gives them 28 days from then to do something. Nothing as yet! Still waiting patiently. Also have MCOL's for Natwest and LTSB which were issued on 29th April, natwest have just acknowledged so 28 days for them too! Bring it on!!!
  19. I may have found the answer on the MCOL website. Their tutorial states that, 'If the defendant does not admit the whole claim the defendant should file a response to the claim within 14 days of service of the claim. However, if he needs more time than this filing an Acknowledgement of Service extends this total time for filing a response to 28 days from the date of service'. Which I think technically means 28 days from the date of service as indicated on the notice of issue.
  20. Hi Michael, You state in your court timetable that the bank has an additional 14 days after they acknowledge in which to file a defence. Does this mean 14 days from date of acknowledgement, halifax acknowledged within a couple of days of issue or are they entitled to the full 28 days even though they acknowledged before their first 14 days was up. Starting to sound complicated now, I think you'll know what i mean Thanks
