    I believe that in most circumstances it would be wise to amend POC's even if it does include section 5..I dnt know if it matters or not but wont ppl at least have to add on all the interest to thier SOC's anyway?, and then any extra charges since the freeze!?! I will probably have to update mine anyway, if not due to the above but I seem to have made a mistake on my original claim anyway, I dont know how I didnt notice it before but have only noticed it since I have got all my stuff back out, I know if I noticed it before it would have stuck in my head. Anyway this is the problem :- Now the sum of my claim is just over £2,200 which includes £120 court fee, so without the court fee comes to just under £2,100, just over £1,600 of this is charges and the rest is interest. The 1st page of my claim form and my SOC reprisent these sums, but my problem is that in my POC it states (1) bla (2) bla bla (3) bla (4) bla bla bla (5) Accordingly the Claiment claims:- (a) the return of the amounts debited in respect of charges in the sum of £364 and any interest charged thereon;. I believe I must have made this mistake because I was doing a few claims at the same time, but I dont no how I missed it then, because it sticks out like a sore thumb now! Do you think I should write to the court/judge and ask for them to send me all info regarding my claim, just so I can double chk if this was what I actually submitted? All sugestions as to what my nxt action should be are welcome. thx in advance.

    Just to tidy this up a bit :- 11/05/07 I sent LBA & SOC. 30/05/07 I filed a court claim. 05/06/07 Recieved a letter from court stating the defendant had filed an ackknowledgment of service. 14/07/07 Letter from court stating that case management will take place on 17th September 2007. 09/08/07 Recieve letter from court that my claim be stayed. 15/08/07 I sent letter to court requesting that the stay be lifted. 26/08/07 Recieve a reply asking that I request this using N244 form. I sent N244 requesting that the stay be lifted. 02/10/09 Recieve hearing date(15th Nov 07)to lift stay. 15/11/07 Due to unforeseen circumstances I was late for the hearing and MISSED it. 24/11/07 Recieve letter from court notifying me that my application be struck out. 23/04/09 Start proceedings to get stay lifted due to hardship. 07/06/09 Hardship route failed.

    More than welcome shadow, I believe that it was just the the application and not the claim, because it states "1. The claiments application be struck out for non attendance." correct me if im wrong but would it not read "the claimants claim/case be struck out" if it was reffering to the claim?

I know what the banks are doing when they do this, but it is wrong, I just had an argument with the bank with regards to my hsbc credit card over £0.09, but it had to be done as a matter of princible, please read:- I recieved my october statement dated 22/10/09 with an outstanding balance to pay of £139.32. I payed £150, via transfer from my hsbc bank account on the 24/10/09, now bearing in mind that the statement date is 22/10/09, this payment was probably paid as soon as I recieved the statement, but in any case was paid, and may I add over paid within 36hrs of recieving the statement. Now on the 13/11/09 I recieved a call from hsbc asking me if I wanted to upgrade my account, I declined, but before the call ended I asked them if they could tell me the balance of my credit card, they replied to me that you are £10.68 in credit, I said ok, can I have this credit on my credit card transferred to my bank acc, so they did. Today I recieve my statement dated 22/11/09 with a balance of £0.09, I know this is due to the fact that they dont add up the interest untill the end of cycle, and that this interest represents intrest that tolled up between the end of my october statement and me paying that balance. But my argument was that how can I be £10.68 in credit with you and get that credit transfered, have made no other debits on my account, but then still be in debt with you, it just dont add up! Eventually after arguing with him for about ten minutes he put me on hold, then came back and said that the 9p had been erased and my balance is now £0.00. You probably think im mad and pathetic and will probably say why not save yourself the agro and just pay the 9p, but im a man of priciple, and just think of the amount of money made when this happens to millions of costumers. I was just wondering if anybody agrees with me? thx, and sorry, but had to get that off my chest!
  8. It was no basis to freeze our claims in the 1st place, this whole process could have gone ahead, without the need to freeze the claims, because this ruling makes little difference to our claims. If the oft had won it would have been great for us, but because the banks won this case it makes little difference to anyone!

    just to re-cap right from the begining of my claim:- 1. 01/12/06 I sent prelim letter to hsbc. 2. 03/01/07 recieved reply asking for soc. 3. 08/01/07 I sent 2nd prelim & soc. 4. 12/01/07 recieved a reply (looking into matters, contact you asap). 5. 22/01/07 letter from them, stating that my copy statements will be with me shortly. 6. 11/02/07 I sent them 3rd prelim & soc, after recieving my copy statements. 7. 14/02/07 recieved offer from hsbc. Now im not 100% sure this is exactly what happened its all a bit scetchy to be fair because I know I printed of letters that I didnt send, maybe had the wrong date on etc. It is such along time ago I might be missing a few things or have things in the wrong order, but this is the best I can come up with, with the info I have! After this offer which Im sure I responded to in one way or another but cant find any evidence of that, there is a big gap, which I think was down to the fact that I was very busy at the time and also had at least one other claim on the go which was at court stage! But any way it picks up again (8) on the 06/05/07 whereby I send ANOTHER prelim and updated charges! Or maybe this was my LBA as the nxt thing was (9) I filed a claim on the 30/05/07. Then on :- 10. 05/06/07 recieved a letter from court stating that the defendant filed an acknowledgement of service. 11. 28/06/07 letter from court stating that my claim had been transferred to southend county court. 12. 14/07/07 letter from court stating that case management will take place on the 17th september 2007. 13. 31/07/07 order made, 06/08/07 order drawn, claim stayed. 14. 12/08/07 wrote to judge requesting a set aside of the stay. 15. 21/08/07 recieved a reply from court asking me to fill out an n244 form. 16. havnt got any record of it, but must have filled the form out and sent it back. 17. 28/08/07 recieve a letter from DG solicitors about the stay, the last line reads " As a general matter, we will ensure your claim will not be adversely affected by the stay of your court proceedings. 18. 01/10/07 I recieve a letter from court stating " the hearing of the claimant's application to lift the stay will take place at 10:00 on the 15th november 2007. 19. I was about 10mins late for this hearing due to unforeseen circumstances, and to make matters worse when I got there it took the court staff about another 10min to tell me where I was! I ended up missing the hearing. 20. letter from the court stating "Upon hearing Counsel for the defendant and the Claimant not attending IT IS ORDERED THAT 1. the claimants application be struck out for non attendance. 2. Costs reserved." This was the last of any corrispondance with the court! 21. 09/06/09 I recieved a letter from hsbc, just basicly giving me an update to the high court case. Apart from a FAILED attempt towards the begining of this year to get my claim paid through hardship, this was the last corrispondence I had with the bank!

    I agree, I will use this time to wipe of the dust and have a shuffle through my claim, and then I can re-asses the situation!

  13. sorry that was for newbody, but forgot to refresh before i posted, so though I would be the next post!
  14. Are you saying that your bank had an order to pay up before the stay and still didnt have to pay it when the stay came into affect? My claim is also at southend court, against HSBC. I must be just behind you in the pile because I believe that they were also just about to be ordered to pay me!
