    I have received my 'statements'. Its basically a list of when they have applied charges to my account. What I have done in the past with other claims, is used interest rates (the credit card were charging me) that was applicable at the time of the charge being applied to my account. This information was ideally from the statements which I have received. Is there any way to know what the historic interest rates were for Alliance & Leicester (MBNA) so I know what interest rate I can apply? If I am not able to find the interest rates, what is the best way to proceed with charging interest?

  3. what you need to is find out when the charges were applied to your account, and what for. I think you may have this information already. You will then need to calculate the interest on the chargesm using one of the spreadsheets on this site. Then I would get the spreadsheet and preliminary letter sent of. To be honest I have not deviated too much from the templates. I would not worry about "admitting" to bad financial planning etc. The point here is that LLoydsTSB have not acted within the law, by charging you £30 for going overdrawn. Therefore they are not entitled to the money, end of. It doesnt matter it was your fault you went overdrawn. A good idea is to read other threads on LLoydsTSB and see what other peoples experience is with them. It does look as though LLoydsTSB will make you sumbit your claim to the courts, at which stage (if a current account) the courts more than likely will stay the case. If you applying for CC claim, this will (or should not) get stayed by teh courts. I am also starting my first claim against LLoydsTSB (although its a CC claim). So will keep a look out for your thread as well.
  4. Starting of a new claim against Lloyds TSB CC. I have got all my statements, and will be sending the prelim of today. I am assuming the 125 Colmore Road address is the one to use for credit card prelim letters? Wish me luck.

  7. as Steven4064 has already said, send them the LBA. I am also claiming from egg, with the standard letter you got, I also got a partial offer. So am wondering why they have treated you differently from me. Did you send a schedule of charges with your prelim letter? This is basically a spreadsheet, showing each individual charge, the date is was applied to your account, the reason why it was applied (overlimit fee, late fee), and the interest element to your claim? If you sent just a letter asking for some money back they may well try to fob you off.

    I have pm'ed you a copy of the letter I sent. I have found MBNA very helpful, I would save yourself the hassle of raising an N1, and just give them some time. However the final decision is upto you.

    I would ask for the interest, afterall its what you have paid for the illegal charges. Send them a letter asking for the interest along the with the spreadsheet showing your calculations. They will hopefully pay you the interest as well. I also started of claiming CI, but changed to DI midway through my claim. Also bear in mind there is a postal strike on, so may take longer for your letter to get through to MBNA. Also they must be busy with all the claims so give them time. They also hiked my interest rate up to 29.9% from the 17odd % it was. I think its a joke...it maybe in response to claiming the charges back..they are trying to get their money back via the hiked interest rate. Suffice to say I have closed one MBNA account, the other now has a zero balance. Wont be using their credit card again!! Good luck!!

    I rejected the offer and wrote them a letter asking for the interest part as well. I gave them an extension of two weeks. They paid the interest within the two weeks. Write them a letter and see what happens...more than likely they will pay the interest part.

    yep, claimed the interest as well. I did not claim contractual interest at 29.9%, however I did claim interest at 17.9% compounded. The contractual interest argument although I did understand it, and could explain to my mate, dont think I could be confident enough to explain it to a judge. Also the difference from the contractual interest and the demonstratable interest I claimed was around the £30 mark. Hence I thought its not worth the hassle of trying for contractual interest. The second offer they made was for all the charges, I refused this and said I wanted the interest as well. I have not heard from them in writing (maybe the postal strike has something to do with this), but checking my account this morning, they had paid the interest element in.
  12. its here There is no specific one for egg. You should use the generic one. Egg will send you a form, asking if you want the full statement for £10, or a cut down version for £5. I asked for the cut down version, as it contains all the info you need. Its easier to go through them, and its less paper, hence friendlier on the environment.

    Some good news, MBNA have finally settled in full. They deposited money into my account without any prior warning So I now have a credit balance on my account. Do you think they will give the 29.9% interest rate they charge me? Now I will continue with my second account, hopefully things will go as smoothly. Thanks to everyone for their help. Anybody know how I get this thread moved to the "won" thread?
  14. All template letters can be found here . I would as many threads as you can, to get the general gist of what you have to do. However the steps you will need to take are i) send a Subject Access Request - to get all your statements, so you can see the charges you have paid. ii) send a preliminary letter asking for the money back iii)send a letter before action, stating if they do not pay you will take them to court iv) file a claim with the courts. Egg may settle before getting to the court stage, however if you do stage 3 above, be prepared to file a cliam with the courts. Also read up on the FAQs, and get as much info as possible. If you have any more questions, then just ask and I am sure somebody will help if they can. HTH
