  5. I replied giving them an extra 14 days, instead of the 28 they asked for. Had a very quick response this morning accepting this. Defence is now due to be filed at the end of May. J

  7. Any update on your claim? Barclays solicitors are trying to stall mine for a month; would be interesting to know if they are taking the same tack with you? J
  8. Heh! She's used to lots of disparaging nicknames - she gives as good as she gets in this household though. The exclusion was added to the policy a while ago. It was added because she suffered a cat fight injury to the tail before the insurance was taken out. They added this after they reviewed her history in relation to another claim. The insurer is pinnacle. I've asked the vet to emphasise that this is a completely new/unrelated injury, so will see how it goes with the insurer. Thanks, James
  9. Still asking for more time: "Thank you for your email dated xx April 2015. We confirm that we continue to liaise with Barclays in respect of your claim and that we are currently awaiting further information. We note that you have declined our request for a 28 day extension for filing of our client's Defence. We ask that you reconsider this request to enable us to investigate your claim fully and file an appropriate Defence. In the event an extension cannot be agreed we shall have no other option that to file an application at Court for a formal extension of time, we consider this action to be an unnecessary waste of the Court's resources and shall claim the costs of such an application from you. We would appreciate if you could respond to this letter by 4pm on 8 May 2015 so that we can take the appropriate action in good time." I still feel like they haven't really given a good me a good reason to grant anything - surely they would have to do better than this for a formal application to the court? Thanks, J
  10. Thanks for the replies - I forgot to subscribe to the thread, so only just spotted them now. This injury happened this weekend when she was nearly run over by a car, it is most definitely nothing to do with the previous history. I've spoken to the insurers and they've not committed to anything over the phone but encouraged me to put a claim in so they can review. On the plus side, the cat is doing well after the surgery - eating like a horse and whinging to be let out. Her post-op check-up was promising as well. It's gonna be tough not to nickname her stumpy from now on though... Thanks again! J
  11. Hi, Our cat has degloved her tail and needs to have it amputated and it's going to be v expensive. I have insurance for her, but here is an exclusion for "tail conditions", which was as a result of a cat fight she had before I took the policy out. Unfortunately, the insurers aren't available until tomorrow morning, so I don't know 100% whether they will honour a claim. It would seem like an overly broad interpretation of pre-existing, but I don't trust the insurers to try to get out of it in a technicality... Fwiw, I have never agreed to the exclusion in writing, as it was added after they got her notes from our vet. Not a good day! J

I refer to your request for a 28 day extension for the filing of your defence. However, as you still have several weeks to prepare, I see no need for such an extension and trust you will defend by the existing deadline. I am, of course, willing to consider an offer to settle on the basis of the Schedule of Charges submitted with my Claim, thereby avoiding the need to trouble the court system further in this matter.   14. Court has confirmed that claim was served on 17/4. I've also received a letter from Mathew, Arnold & Baldwin solicitors to confirm that they are representing Barclays and they would like an extension... Deja vu, eh? J
  15. CCMCC have been quite slow processing my N1, but the cheque has now been drawn on my account. Should receive the confirmation of service soon. J
  16. I can't comment on the final outcome but I would like to thank you all for the support I've had along the way. Its been invaluable and I feel like I have learned a lot from this community. I think it's amazing that this forum empowers people with no legal background to challenge the status quo and I will try to disseminate what I have learned both offline and online. I feel that this "grass roots" movement is important and may help to realise change in these institutions. J
  17. Just an update to say that Barclays have bought back my debt and I have received a letter of assignment this morning. It claims this happened on 23/3/15, so it has taken quite a while for the letter of assignment to come through. J
  18. Another letter from Barclays claiming that there is nothing to refund since the charges have been added to the capital balance. Yawn... I guess they will receive my claim in the next week or so. J

My opinion is that you are doing the right thing by pressing on with the mortgage arrears and ignoring any correspondence about the overdraft balance for now - if it's sb, they have no cours of action for direct litigation anyway. I would also advise that you don't raise the od balance with Barclays litigation, as they aren't always that "joined up" in their thinking. I also have an outstanding of debt that has been sold on and ithey have made no attempt to set-off against this for my cc claim (although they do want to set off against the balance that was left on the card). No promises on this one, but it's up to them to raise this following proceedings. Keep at the muppets! J
