  1. Firstly, no -I have not forgotten that I PMd you. I'm not sure why you mention it. My comments above were in relation to you suggesting that Caro should not comment further - it is not for you to determine Caro's input as a moderator. Secondly, I see no reason why a user cannot simply share the information that may be required on the forum, rather than by PMs - if they can't display an agreement then they can simply type it out (leaving any personal information aside). There is no reason to suggest that someone might have to take paid legal advice simply because we have warned against the use of PMs. If you receive a request to review a contract, ask the user to type it into a post - simple??

  2. Due to a serious cash shortage we have had to cancel our Google adwords campaign. We are doing very badly in the Google rankings. If you search on "Bank charges" at least the first two pages of hits belong to the banks' own sites. Are you happy with this? Many of the websites which link to us are linking to the forum. However to move up the Google ladder, they need to link to our home page at www.consumeractiongroup.co.uk If you have a website, it would be helpful to use the following code for your link:- Even if you change the text, please keep the words "bank charges" in it. If you know a website which links to our forum or doesn't link at all, please could you contact the webmaster and suggest that they could link using the above code. Finally, you can help spread the message by including the following message in your signature:-

  3. Claimant has account (A/C No) with Defendant from (Date a/c opened)conducted on their standard terms and conditions. Claimant is claiming the return of (£0.00 = amount of charges claimed) taken by Defendant in charges over (X) years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e. In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from(Date of 1st charge) to (Date of filing claim) of (£0.00 =The interest in the 8% spreadsheet calculation) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00p = Amount of charges claimed x 0.00022).

  4. Hi Monstermind I included irregular account charges in my claim. If it hadn't been for their other charges my account may not have been 'irregular'. Would be interested to know if anyone else has any thoughts on this. Bettyboop PS Good luck

  5. Hi Dicko You never know the other statements may have turned up by the time you get back (Well you can hope!!). When you get back do an estimated claim with the info you have and do the prelim. You can do it in your own time and if you happy to wait then enjoy your time away and then carry on when you return:).

  7. From the Banking Code: Also follow this link http://www.consumeractiongroup.co.uk/aboutus.php and read the left hand column, The Banks' Abuse of the Credit Register. From what I understand, if they do issue you with a default they can't pass this on to the credit agencies while the account's in dispute. If your account is in arrears because of charges and you claim them back, I don't think they can then pass the default notice on to the agencies. Good luck.
