I recently posted in the 'HARASSED BY MBNA THREAD'

 

which i was given some good advice and since then I have sent off the SAR and CCA by recorded delivery after using the templates.

 

My story.. I was working contract (teaching) and my classes were cut due to low intake. In November I was not paid all money due to not working and and there were issues with some other freelance money not paid to me so there was no money coming in and I have evidence of not being paid also with MBNA's mounting interest rates crippling me:-o.I was unable to pay for that month.

 

My total debt is £6,000 all to credit cards, MBNA, Capital One, Halifax and Barclay card. The biggest amount is MBNA which was £3,000 now with their interest it is £3,300 (can you imagine) this is due to them not making an arrangement. I was advised by National Debt line to send in a earnings sheet which i did and Captial One acknowledged this but MBNA never replied they kept ringing me and forcing me to pay more than I could afford. (halifax is £1,000 and barclaycard is £250 I can pay them as they are very small amounts per month) also Captial One is £1,500 so I have agreed with my current salary to pay Capital One and MBNA just £50 a month each which i think is a good amount as opposed to £100 per month MBNA was asking for. I also sent an earnings breakdown to both, Capital One asked for proof via wage slip and bank statement which i sent they then sent me a letter saying that I can pay the reduced amount and they will freeze the interest but i have six months to pay the arrears, but MBNA never acknowledged my form and just keep on ringing via Aegis which i am logging they also sent me a letter yesterday stating that 'They have made several attempts to contact me about my account and i need to pay asap ':?. funny that! no acknowledgement of the letters wrote or cheques sent hmmm. By the way I am just still paying the £50 a month to both of them as advised, and I am a homeowner too but was informed by debtline that it is a non priority debt and to keep paying. I have no other debts only credit cards and this situation could have been rectified ages ago as I had a regular payment history with all my cards I feel angry with MBNA I have also sent an complaint in from your templates.

 

Anyway I await notification from those muppets so can somebody please advise me what happens next I read the threads about SAR and conclude that they (muppets) have 40 days to reply, and as soon as I receive the CCA agreement should i post here (with details blanked out of course lol) ..?

Hi fedupbymbna- my namesake!!:D I don't think anybody at MBNA can read to be perfectly honest. You can send as many letters as you like, you will never get acknowledged. They will just hassle you to pay an unaffordable amount and don't take into consideration your circumstances at all. When did you take out the card? I have a complaint with the FOS about them and the way they flout the consumer laws. When you get your agreement, post it up so we can all have a laugh at their cut and paste efforts. They will threaten you with all sorts- CCJ, charging orders but they haven't got the b*lls to follow it up and will probably sell it on to some other muppet. Good luck:)

Hi you 2 fedups, from this fedup :) I followed you from the harassment from MBNA thread. Having read your post #1, I totally sympathise with you but I feel that we all started out in the same position as you. I sent my initial Income & Expenditure form to MBNA on 08 Sep 08 requesting a temporary hardship repayment plan but 40 phone calls from them in 8 months and nothing but their standard colourful template responses received from them is all I've had. I have ended up, unfortunately, with 3 accounts with them, none of which were taken out with them initially, all taken over by them, Bank of Scotland, AOL and Virgin. They are the most irresponsible, lying, bullying, criminal people I have ever not chosen to do business with. Stay strong, stay legal, put everything in writing, recorded delivery, do not put up with their 'we are a telephone bank' tactics, seek good advice from this forum or any other non-fee paying debt management organisations, but pleeeeeese do not give in to these cretins.

 

Thanks for listening, good luck, site admin will put me in order if I have legally slandered anybody, but stand your ground. You sound like you have genuinely attempted to make good with your creditors and by law, they must comply. Don't let them bull you into thinking otherwise :)

Fedubbymbna. You seem to have things under control for the moment. Dont let MBNA get you down. If they havent already advised you.. they are an American Bank and UK rules dont apply to them.. Twits..

 

I would point out that you are under no obligation to send in any sensitive data ie payslips, bank statements to these companies. They are just information gathering and by letting them see these you have basically given them permission to pass on more data:( If you are asked again. Say no !

thanks guys i just read all the posts i you all make me feel must more stronger. I even read the ' i used to work at mbna thread' and how they harrass you at the end of the month well guess what today i got three call so far and a text saying IMPORTANT PLEASE 0800 ARSWHOLE as soon as you get this text, on impulse i was gonna ring to explain but I am not doing anything as i have cheque stub and letters and i am glad that you all told me about the signature so I am hanging onto the card. The better be careful ....thank you guys.

Hi guys

Since the complaint letter I have had two letter One from MBNA and one from Virgin??

The calls have stopped and the MBNA letter said "here is the information you request

Sort code *******

Bank ac number **********

 

please pay the minimum on your statement ??????

 

The Virgin letter says

 

"Thanks (impersonal) for getting in touch with about the customer services you recently recieved. It's something we take very seriously and we're sorry to hear it wasn't up to scratch on this occassion.

 

We're currently looking into the matter and promise to get back to you with a full response in writing by February 23. 2009"

 

Maybe cause I mentioned Martin Lewis or some other show , can't we contact Watchdog or something .

Good luck Fedupmbna, you are most definitely not on your own - I can't see how MBNA can realistically survive as any kind of brand the way they are going.

I wonder if MBNA are the new Enron :roll:

I got a called today from Virgin stating that my account is in arrear (shock horror) and when I find out how much my outgoings are they can set up a payment plan, but If i can pay £70 next week to clear the old arrears they will stop calling me. I told her about the SAR and she asked "what is that?" do I still make the payments (the fifty not the £70 ) whilst I wait for the SAR?

i now had an email from them

 

"Your account remains overdue and your payment history suggests that you are struggling to repay your debt. We are aware of the problems and stress that being in arrears can bring and we would like to take the opportunity to help you, please call 08000 280689 today to discuss your options. Our specialists are available Monday to Thursday 8am to 9pm, Friday 8am to 7pm and Saturday 9am to 3pm. "

 

Do they not read my letters yesterday Virgin and today MBNA.

My Email response.

 

 

Please refer to my letters send to you by recorded delivery about my financial situation and my request for a Subject Access Request and my CCA.

 

I also included documentation regarding harrassment and also my financial situation.

 

I shall be adding this document to my files to present to the financial Ombudsman after I await my reply from your complaints section.

 

I only wish to have written correspondence in relation to my offer of reduced montly payments and frozen interest on my account.

 

I have been wrighting to you since last November and there has been no response to date regarding these letters.

 

I await you reply with respect to the matter above.

It's a way of getting you to phone them !. Dont, keep everything in writing.

They have sent me my 'agreement'....somehow managed to copy my signature & even better they have filled in all the blanks!! obviously not my writing...spelt my street address incorrect,,,spelt sales manager as sales manajer!! & i apparently was working at a company i wasn't even employed at during that time!! quality!!

 

How would you respond?

That is hilarious. I hadn't really realised the extent of how awful they are till I found this forum recently. I find it really heartening in a strange way, just because I know I'm not alone and it also demonstrates what a lot of muppets they are.

IMHO, if they have copied your signature and you can prove this, I would get a copy of it to Trading Standards as soon as possible.

 

The Financial Ombudsman will not adjudicate on the enforceability or not of an agreement as many of us have found out. Trading Standards are the ones you need to complain to.
