COUNCIL TAX AND BAILIFF PROBLEMS!

 

Bailiffs are out to make money, the privates would lie and cheat their way through as clearly demonstrated on Whistleblower.

 

Advice :-

 

What ever you can afford just pay the council direct, write to them with your proposal, and what ever you propose send the first payment in.

 

The council has to by Law credit your account with the amounts paid, it makes no difference.

 

The reason the council is showing you the door or refusing to accept your deal is because, the bailiff and council have an agreement, that is to say, the council refers your case to the bailiff, and, the bailiff charges what he wants, on condition that the council to do not interfe with the process of the bailiff making money, in essence so as the bailiff does not get upset and throw a strop, the council say "sorry deal with the bailiff". The bailiff in return knows the council won't back you, so he/she then has the "authority" to hound you.

 

But if you start paying the council the installments, the amount claimed by the bailiff instantly becomes incorrect, and therefore he/she would need to adjust it and demand less on every visit, thats of course if he does not bump it up on every visit, which they cannot do.

 

Even if you get called into court or if the Council want to make you bankrupt, the council would need to explain to the judge why they refused your reasonable offer, at least by offering payments and actually making them no matter how big or small, would show your intention that you are making an effort, and perhaps in turn that would prove the council are just being bloody minded.

 

Also remember that the council dont want to interfe with the bailiff because "who would pay the expenses incured by the bailiff".

 

Although the bailiff has the right to collect the expenses from you because it becomes part of the warrant, but lets face it, which bailiff is going to bother, the truth is most will swallow the fees, and go onto the next defenceless baby seal, Thats of course if you had paid off all your outstanding bill to the council, excluding the bailiffs fee's.

 

Pay what you can put it in writing, and remember the Council can Recall the warrant from the Bailiff.

 

Remember :-

 

Ignore Bailiff and send your payments direct to the Council, they have to credit your account with the amounts you pay.

 

With the letter of offer send your first affordable amount, and stick to it, you do not need to pay the bailiff direct, he is after all a "debt collector" with the ability to seize goods, only if you have already let him in PREVIOUSLY.

 

You CAN NOT be arrested if you are paying, the arrest option is only for people who can but won't pay, and thats after a judge has issued the warrant.

 

By asking you to sign a walking possession, he/she is trying to tie you up, so if you screw up then your going to face a lot more difficulties.

 

By also getting you to sign the WP, he/she seems to appear to be doing his work, for his companies benefit of course, and charging you for the previledge.

 

Remember he needs to visit the debtor within 7 days of the warrant being issued and thats you!, you are his/her :- Meal Ticket - Dinner for tonight - Rent - Cinema Tickets -Petrol -.

 

And finally always get the bailiffs full name ask to see Identity Documents, then PM TOMTUBBY with the bailiffs name so that it can be checked against database to make sure that the bailiff has legal Authority from court to act in the capacity claimed.
