Complex paradox ?

I sued the bank . I applied to have the 120 pound fee remitted. They wanted to see some evidence that I didn't have with me at the minute. I payied the fee but they said to me that if I could get the proof they wanted then they will refund it to me.

 

Now for the question.

 

In the claim + particular's of claim + Amount claimed (on the front of N1) I have stated that I am claiming 120 pounds costs from the defendant !

 

What would happen if the court refunds my court fee while in the form I am actually claiming it from the defendant ?

 

How can I avoid sleepless nights and endless complications. I don't really want to be deprived from my 120 pound fee for a couple of years with the bloody oft testcase ! but I don't want my claim being striken out for claiming court costs 120 pounds when I got them refunded.

when you file in court, you did 3 copies remember, 1 for the couty, 1 for the bank, 1 4 u. where is yours pray tell?

not sure but if you do get the refund, maybe you could then do an amendment. it would cost £35 though

Yes claim the fee back and then fill in form N244 to make an application to amend your claim form. This generally attracts a fee of £35 but if you are exempt from court fees you will not have to pay.
