      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone! i must say - i got a letter from Tommy McLean fobbing me off after i rejected his offer of £830 (when my claim is for £4550.00!) and it was pp'd by Ross McDonald!!!

Looked on the cobbetts site at pictures of all there partners. Loads of them, they must be a very big firm. All the partners and team leaders appear on there - Apart from Lynsey B!

According to one of my letters off Ms Burgoyne her middle name is Clare :-)

Well everyone,

 

I have some good news and some bad news.

 

The good news is that:

 

I have WON!!!

That's right, Cobblers have sent me a cheque this morning for £3.7k!!! All I need to do is check that is right (Doh! - left my spreadsheet at work!!). No doubt the RBS will still concoct some charges on my account this month, but I'm sure that they can be sorted out, at least I know what to do now!!

 

All I can say is that this is the best thing I have ever done for myself. Without the help and guidance from this Site I would have been looking down the proverbial barrel of a loaded gun. It may seem that I have had a tortuous route, but it hasn't been that bad. The standard letters, spreadsheets and advice have worked. If Cobblers took a better attitude to their Client's money (and I do mean the RBS and not my money), this would have been solved a lot quicker and not have cost an extra £500.

 

Don't just sit there thinking about it, DO IT:cool: !!

It's just a shame that Col's Caff will have to close, I'd got some great plans for expansion: the Cobblers Bar, special 50% deals, mispelt specials and threatening looking prices; the Mclean Room, all fur coat and no knickers, leather look pvc sofas that really are not comfortable and coffee that leaves a sweet taste in your mouth!

Col your thread has been an inspiartion for daily reading, watching the developments and if any bank/credirt card companies are reading these mails, then this is what it is about. we shall not be moved, we shall not we shal not we shall not be moved by any of the fob off stories qnd misadministartion of our bank accounts any longer. you who make the decisions to put these charges in place, then concoct such trivial reasons for their pathetic aplication of thier bent rules, and hey presto they are gouing to be beat. so all youse bank staff get your act together and start refunding all now, because you are compiunding your errors by not settling at the earliest stages.

Well done Col, just been buying chrissie pressies with our RBS refund, so happy to hear so many others are gonna have a good christmas after beating RBS and cobblers. Got a couple more charges on my claim between my lba and the settlement so might just drop old "tommy m" a line about those ;)

Btw I am no expert just give notes based on what I have read on here and other forums/sites, plus my own experiences and investigations.

 

All ccj's now dropped off file, 2 yrs to go to clear file.

All old debts either settled or made unenforcable.

 

RBS MPP-Full offer at 8 wks from first complaint

RBS Overdraft loanguard-full offer at 8 wks from complaint

Citicard ppi-with FOS finally paid 8 months after offer through FOS!

Capital one x2- with FOS

Monument ppi-with FOS

aqua x2 ppi-partialled settled still pushing for the rest

Black horse ppi-offers made and accepted except for one early loan they say no info held-still pushing for payment
