      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

Sent off my SAR about a fortnight ago and received a letter saying they are currently investigating my complaint and I’ll have a response by the 2nd July.

Is this normal? Would have thought they'd investigate it after I had made my initial request for reimbursement (once I’ve got the statements).

Do MBNA/Abbey ever make a nominal offer before sensing out the statements?

Im not sure if youll get statements, seems a few lately get a list of transcations, with transaction codes, im trying to get copies of my statements as we speak :rolleyes:

 

Also seems you will get an offer or "goodwill gesture" when the transactions arrive, mine offer was £780, added charges up, came to £1700, they may get the offer from the OFT guideline £12 off their charge of £25, but not too sure.

The credit card accout is all settled (nil balance) and was closed off about a year ago. Had had it for 2-3 years before then so still well within limitations.

 

Pretty sure i had been charged quite a lot by these guys so will interesting to see how much it adds up.

 

I've got a feeling there they and palm me off with a low offer before they send me the statements.

 

We'll see after the 2nd of July.

You can only request a CCA if the account is still open. Doesn't stop you doing a SAR though

Need some help please guys/gals.

Okay I finally received my statements/transaction reports from MBNA along with a covering letter stating why they disagree that the charges are unlawful but there still prepared to offer £250. My claim is worth £475 in total.

 

It states this will be on full and final settlement and cheque will be with me in the next 10 working days.

 

I want to continue my claim form the remaining amount but I’m scared that if I fire out a rejection letter that they won’t send me the cheque.

 

So should I wait until I get the £250 cheque before I chase the remaining amount?

Didn't get a response to me question but I’ve sent a 'partial rejection letter' to MBNA rejecting the £250 gesture of goodwill offer, also stating I’ll take it as an interim,

BUT I haven't actually received the cheque yet. Do you think they'll still send it?

I'm seen about this contractual interest we can claim on these credit card claims but firstly how much is it for this card and has anyone got a linky to explain a bit more about it and finally anyone got a MBNA spreadsheet for doing this.

Hiya Madmax,

sorry you didnt get any help earlier in your thread. You did the right thing accepting the amount as partial settlement...

You don't need a MBNA spreadsheet, just go to the templates and open a credit card spreadsheet... the simple one I think I used.

You can tell what interest rate to use from your statements, its the monthly rate x 12.... for a lot of us it is 24.9%

Yes, do 24.9% I have read somewhere that there are some people who have negotiated settlements on the phone with MBNA, and even their staff use 24.9%, nothing to loose, so go for it xx

Received a further letter from Shabby Bank on Saturday.

 

Further goodwill payment of £210 is on the way. So thats full settlement bar £15 (250 + 210 = £460)
