      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It should be calender days from the 12th but as this is a DCA they will probably assume it is working days.

 

As such when the 12 days are up send them a chaser.

Also, I'd be inclined to let them chase you! If they can't find an agreement, they just may go quietly away. (A long shot, I know).

 

However, if they do start to chase again after they have defaulted and committed an offence, then you can remind them of their shortcomings and report to TS, OFT and all!

Ok so to clarify.... I need to wait 12 working days, then send them a follow up letter. If they don't send anything back by then, then just wait 30 calender days......

 

Mmmmmmm....... hopefully they won't send anything through!!

 

Also is it 12 days from the date of my letter or their's? :?

OK, the best approach is NOT to send them anything untill they demand payment, NO follow up letter, then remind them that your CCA request is out standing.

 

Also is 12+2 WORKING days. The +2 is to allow for postage and processing.

Of course if you have sent it recorded then you'll know when the 12 days starts.

Be VERY careful whose advice you listen too

12 days after they signed for the CCA.

 

Stop payment if you have not recieved an enforceable CCA.

 

The only contact I would have is to ask for a copy of their internal complaints procedure and not mention their default.

 

If they ask for payment you may wish to write to them to point out the default.

 

If they dont supply an internal complaints procedure after 8 weeks complain to the FOS.

Oh right now I have a problem! I've just got a letter from them today saying that they will pay me £738 as a gesture of goodwill......

 

Now, I've always told myself that if it came to this I would'nt accept it.... But now its here I just really don't know what to do....

 

It does state 'This offer is a goodwill gesture and is in full and final settlement of you complaint against Halifax.'

 

Does that mean that I then wouldn't be able to take it to court, or if I did the court will overturn my claim?

 

Also it says 'If you do no wish to accept our offer, please return this payment and contact me on the above number.'

 

The money would be really handy at the moment because my car has been off the road for over 3 mths because I can;t aford to repair it, and I owe so much money to my parents they are thinking about cancelling their holiday because they have'nt got together the spending money for it.....

 

So you can see the predicament I'm in....

 

Please advise what you would do in this situation.....

 

P.S the total amount being claimed is £1386 (£1561 with interest).

My personal thoughts are - why would I take £738, when they took £1386 (£1561 with interest). off me??

 

The letter is a fob off letter and if you wanted to go for the whole amount then you should send one of these http://www.consumeractiongroup.co.uk/forum/bank-templates-library/25716-rejecting-offers.html

Once you have filed at court, it should only be 2-3 weeks until you get your money.

No I don't claim any benefits and work full time. Its just that I work in call centre so don't earn much money but its more than minimum wage. All my money goes on paying debts though.

I have now recieved a letter from them saying hat they have been trying to contact me at ........ ................

 

The address they have on both the top and in the letter is the exact same address?! Why do I need to confirm my address with them even though its the one they communicate with me through? Am so confused! :confused: :-|

 

Also I notice they very nicely supplied a giro slip on the bottom of the letter :D

The address they are trying to confirm is your current address?

 

If it is then I would probably ignore the letter for now. They are so intent on confusing you that they have completely confused themselves :D or they have an alterer motive :eek: .
