      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi. well....i have sort of sent it in to Cobbetts and the court already, wasn't sure if i needed to do that before my preliminary hearing.....so i thought, well better to be safe than sorry, so i sent it in!!!!

 

i also hoped that cobbetts would see i mean business and settle before i have to go to court!

 

Have i messed everyting up now do you think??

well, so far they have said to go to the preliminary hearing. they said they might change the court,etc.

 

does natwest or cobbetts have to be present for the preliminary hearing as it will only last 5 mins?

I'd be surprised if cobbetts turned up LL.............. they tend to go for the 'invisible look' whenever there's a court hearing!!!! Read up on the 'Got a court date' thread above and get everything ready. You'll be fine though - you've already done your homework! xx ;)

so if they dont turn up, will the judge say something or can i do something about it??

 

or would it not be that important as it isn't the actual court date, only a prelimanary?

it says that a top barrister went to help, backed by the CAG to help people with their cases!!!

Hi. I am reading your thread and thinking how similiar our circumstances were at first. I am at the stage where Cobbetts have sent a CPR 18 request... I have sent a reply refusing! And now I am just waiting - eek! I would be really interested to find out how you get on.

I have finished the first one and WON. I think the only thing that I really learnt is that you have to play them at their own Game.

 

I think the next four times I am going to try it a bit different and take the initiative. I do not know what other think but right from the start I am going to go in at them. My idea is to launch a CPR 18 on the BANk as soon as I can after the starting court action. In this manner they will be left with either a compliance or if they try to counter with their CPR then they will risk having to explain the consequences.

Hi louise78. oohh...so you are getting on ok then? i know, it does sometimes seem scary when you recieve their defense and cpr 18 and all legal stuff!!

 

i am just waiting for my prelimnary hearing, which is on the 11th july.....so once that is over, i can hopefully get myself ready for the REAL court date.

 

does anyone know what an LBA is? i have read the abbreviation on a couple of threads, and i am being REALLY stupid and can't work out what it stands for!!!!!!

Hi Hedgey, some GOOD news!!!

 

Recieved a cheque in the post today from Cobbetts for £5,124.45!!!!

 

Can't actually believe it. Didn't get a phone call or anything.....just arrived in the post all by itself!!

 

So now i don't have to go to the prelim on Wed i take it??

 

I actually did it..... I WON!!!!

YIPPEE!!!! Thanks sooooo much for all your help and advice, seriously wouldn't have got this far without the CAG.

 

I WILL be donating some of my lovely cash as soon as my chque clears, to say a proper thanks.

 

So keep going everyone, if i can win....anyone can!! xx
