Ok, lets say for argument sake (this is merely hypothetical) that you have tallied up all your charges and so fourth and you end up with a final figure, but this figure is wrong but you only realise this after you have made your claim.

 

1. Are the banks actually checking these spreadsheets we are doing, and what are the chances they would pick this up ? I mean even if is only a few pence, but on the other hand, it maybe more. I doubt it very much that all of us are getting out figures correct.

 

2. Can they contest the amount and if so, then what ?

 

3. What if they paid up and then after the fact you realised you made a mistake that they didnt pick up at the time. Can they recall any monies paidif their auditors picked this up after a payout ?

If you realised you had entered the wrong amount you would need to contact the court immediately to see if you could amend your particulars of claim - there would likely be a fee for this so do check and double check before you submit your claim - taking somebody to court is serious and not to be rushed in to.

 

If the bank contested the amount you would have to prove your amount was correct. If you couldn't do this the judge would have to make a judgement based on the amount the bank think it should be.

Thanks for your swift responce, however maybe you have misread or maybe i have not explained properly.

 

I was questioning what would happen if you realised you were wrong AFTER they had paid out and what if the bank also found this out found this out after they had paid, would you be liable for the shortfall ?
