      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'm submitting my court bundle on Thursday and was just looking through YB AQ, they requested a one month stay to attempt to settle the claim, when would the judge decide to put this in place? at the court hearing or before?? Does anyone know????

Thanks Caro, was talking to Theodane earlier and she's submitting more evidence to court, we are both at the same court on the same day, have also decided to submitted more evidence, funnily enough i'm so excited about the whole thing now cos it feels like its finally coming to an end, fingers crossed it all goes to plan :D

Good Luck with your pursuit of these bullies, you are about a week ahead of me, I received Ms Ross's notification of intent to file a defence and I am just in that period where I am waiting to hear.

Having reviewed other threads it seems that the YB want to intimidate us all into submission.....well tobydoby personally looks forward to kicking their backsides and will not back down for all the years of them taking money off me.

 

Keep me posted and give em what they deserve!!

Just a quick up-date, just been to court to submit some more extra information that i wish to rely on in court.

 

Whilst there i checked the court listings for the day, as i always do, and everytime i have been there there have never been any bank cases listed!? is this strange or a good sign meaning that most banks settled before the date?!

 

Anyway rang the court yesterday and today to ask the same question; 'have YB submitted a court bundle yet' (theres only 7 days left to the hearing), anyway they had to go and check, they actually said to me on both occassions that they did have court bundles from Clydesdale Bank but didnt have one for me, its all strangely bizarre dont you think.

 

So i have faxed CB today to let them know that i have submitted a bit more evidence and copy is on way to them. Will prob give them a ring on Monday just to make sure they have received everything ;)

I suggest you keep away from phone calls stevie, but you could just send them a fax to remind them that the court date is looming and you haven't had a bundle. You could also remind them of the full amount of your claim, your court costs, interest up to date, and daily interest amount accruing until date of settlement.;)

Ive just got home and found a slip from the post man saying that there is a Special Delivery letter waiting for me at the post office ........ cant pick it up till the morning doh!!! Also got a PM from Theodane who is in the same court as me the same day telling me that she received her cheque by Spesh Delivery this morning! HURAY ..... AM SOOOOOOOOOOO EXCITED I CANT BREATH ....... I JUST KEEP RUNNING ROUND THE HOUSE SCREAMING :D ITS GOT TO BE A CHEQUE ITS JUST GOT TO BE !!!!!

I couldnt get to the post office to pick my letter up due to work comittments so someone had to go get it for me, then couldnt get to pick it up till gone 6pm .... so today was an agonising long wait! But well worth it! Phew!

Am blowing into a brown paper bag as we speak to calm down, wot will i be like if it is a cheque OMG! how will i sleep tonight :eek:

 

I remember a night like that myself back in January. When I opened the envelope in the car I reminded myself of Delboy and Rodders in the Reliant Robin when they finally became millionaires.

 

Congratulations. YB are certainly paying out a lot lately. I love it.

 

As for flooding. Tell me about it!!! 16 inches of filthy water flowing like a river through my house last night, and my hubbys car flooded too! Thank goodness we're well insured and no-one was hurt.
