Here we go then - last bank/credit card claim (other than the Barclays "over 6 year old" stuff.......

 

SAR sent some time in Feb

 

Prelim sent some time in March (never acknowledged by Abbey)

 

LBA sent 14 days ago

 

Called Abbey last week to give them a kick - the customer service person who spoke to me claimed to have "a diploma in law" (is that like a mother in law?) and lectured me for a few minutes about why I was wrong and they were right.

 

She told me I would not get any money - I told her to look up my/Mrs C's 2 sucessful claims - she did and then said they were "exceptions".

 

She asked why I really wanted to go through all the hassle of filing in court, and if I waited for 8 weeks then the complaints procedure would surely resolve something amicably.

 

Told her I was filing 14 days after my LBA was dated, through the HMC online site.

 

She then admitted that she hadn't heard of MCOL!

 

 

 

MCOL submitted today

Blummin eck, I wish i had spoken to her, I would have given her chapter and verse ROFLMAO AND quoted case references , oh how they do like to try it on :D

It made me chuckle at the time, although I can see why individuals who are making their first claim get put off and accept derisory settlements.

 

I wonder if the FSA would comment on staff of financial services providers providing legal opinions (and advice, however twisted) - surely that is a breach of what they can do, regardless of whether the individual has an O-level in law!

Its that old adage "the exception proves the rule" coming true!

Been a while so here is un update:

 

MCOL filed

 

Claim acknowledged

 

Defence issued

 

At same time as defence issued, Abbey offered 65% settlement as GOGW

 

AQ waived - case passed to Wandsworth County Court

 

Contacted Ashursts (although they have not been engaged on my case yet, couldnt reach Abbey on any numbers they provided)

 

Told Ashursts would not accept 65% and would be requesting 14 day full disclosure (per new AQ strategy)

 

Ashurst's said that Abbey wouldnt enter a bidding war, but would consider a counter offer

 

Made a counter offer of 100%.......

 

Will let you know what happens next ;)
