Well its nearly 4.30 and no chance of them calling me back now as they are shut.

 

I wouldnt like to be hanging by my fingertips off the edge of a cliff waiting for her 10 mins. LOL

 

I suppose I'll have to wait now till tomorrow and I'll ring first thing.

 

I know they have lost it good style, and I think Im loosing it too.

 

I guess its back to the waiting game for me then.

 

If they want another one that means waiting another 2 wks or so.

OMG Overflow and I thought I was having a bad day. I would be banging on their door as soon as they open in the morning and writing a VERY stong letter to the Court Manager or whatever they call whoever is in charge. But as SSL says it is their mistake, so go and chill out for a while with a nice bottle of plonk and relax.

Just to update after all the messing about yesterday.

 

Today I rang the Court at 10-15 and was put through to the Judgements Section.

 

I explained what happened yesterday and asked if anything happening.

 

I was informed that they had found my form and it had now been passed to the Judge.

 

Said I should hear something within the next few days.

 

I wonder will I.

 

Ive been out all morning but when I came home there on the floor was a letter off Halifax.

 

They are telling me that they wrote to me with an offer of goodwill in full and final settlement (they didnt mention that in the letter)

 

Telling me about the test case and how they have asked FSA to suspend the normal timetable for dealing with complaints.

 

Then the put;

 

"However, the goodwill payment the bank made to you ( they have taken it back) still stands and you can accept or reject this offer.

Please return attached form within two months from the date of this letter. You should be aware that if you accept this offer it will be in full and final settlement of your complaint. This means that it would be unlikely that you would be awarded a further sum even if the test case indicated that you could be entitled to a potentially larger amount. Though this does not preclude you asking for repayment of any future charges if the coourt finds they are unlawful.

 

If you decide to reject this offer, you will need to repay the money that we have already paid to you."

Are they expecting me to repay what they have already taken

Do they not realise that it is way past that stage.

 

I think they have forgoten about Filing a Defence , they should have done that by the 23rd July.

 

What happens now .?

 

I am going to ignore the letter from them and wait to see what the Judge says.

 

Do I now expect to just win by Default or will I have to make an appearance in Court.

 

Dont suppose its any use speculating on this as I know from experience that nothing happens the way you expect it to.

 

So for the time being its back to WAITING again but at least I know its a wee bit further on now.

Nothin today, didnt expect anythin really, bit too soon I suppose.

 

Just thinkin though does any body know if even if I get the Judgement by Default, will I still need to go to Court.

 

Ive read the P Pearl book but doesnt really make it very plain,(could be just me being thick)

 

See I started doing the bundle a while ago , just in case but then stopped . Should I now get it finished on the off chance that I will need it or not.

 

Any advice would be appreciated.

 

Has anyone "WON" this way perhaps you could let me know the thread .

Grant I could think of better ways to spend an evening but if its got to be done then-------

 

Have you heard from the Court then or are you just one of these organised people.

 

I started to do mine ages ago but then I thought Id wait and see what happened, Gone for Judgement now as you know so didnt need one.

 

Unless of course I DO need to go to Court , not really sure you see what happens now.

 

Going off the point Ive got a new SNOTTY thing.:o

I had a letter today from the bank, but it was only my new debit card.

 

I keep checking my account just in case they decide to put money from GWG back in.

 

Ive come this far now not going backwards.

I know the feeling the ink you use on all the documents on here is phenominal, and its not cheap either.

 

Cant figure out why Ive not had any thing from them myself, think mine must have slipped their notice, (hope ive not tempted fate in saying that:o ) You watch Ill get letter now on Tuesday saying the Judge has allowed them to file defence late. OOOOEEEERRRR. LOL

 

Hope all goes well for you and ill be keeping my beady eye on you as well .
