Handed in my small claims to Ayr sheriff court yesterday.

 

Posted complaints form to the information commissioner yesterday regarding statements for two accounts originally requested in November,well lo in behold they arrived this morning.

 

Phoned Information Commissioners Office to cancel my letter.

 

Have now totalled up these two accounts charges come to about £500

 

Can i start to reclaim these back while i have a small claims in for another account or should i wait? And also can i put the two acccounts together as one claim?

Hi, Katierose.

 

Don't see why you can't put the two accounts together as the amount claimed is not in excess of the £750 small claims limit. As for when to claim, it's possibly better to wait until your first one is settled as the court may lump the three claims together,maybe taking your claim over the £750 limit. Sorry I don't know the amount you are claiming in your first claim.

Hi Scott ,Thanks for you reply will hold on to get the first claim out the way if the three accounts get lumped together it would be about £800 before interest(£300 first claim).

Well was back in court today for recall of decree

 

Bank wanted the recall due to admin error and claimed they were making payment within 14 days of the 8 th of June this did not happen

 

Judge allowed the recall to happen,and asked if i had received a cheque from the bank and i said no,Their agent had a letter claiming that they had sent a cheque and the judge said what more admin error.

 

The agent then asked if they could have a 4 week continuance which the judge said all that will do is cause more expence and refused.

 

He then awarded me another decree to include expences for today:grin:
