      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hope someone can help me. Im at the LBA stage so sent letter off and had no response they have until Thursday next week then need to send my Small Claim Summons which im now sweating about. I called court to send me out paper work which I have received and thought I would spend tonight filling in spread sheet re charges. This is where the fun begins. I explained to the court that my charges are for £2006 she advised that I make 2 claims one for £1500 and another for the remaining £506 however should the £1,500 include the interest at 8% so that it totals £1,500 or is it £1,500 plus the interest? Also using scottish simple spreadsheet therefore should I include column F (is this the total int at 8%). Also do I then need to complete 2 spreadsheets 1 for each claim.

Also I have also went back 6 years and all letters sent to bank I stated 6 years(is this a big mistake) :confused:

 

Not looking forward to filling in these forms either. Any help would be greatly appreciated.

Hi, Bolo.

 

Don't panic. You will have to make two claims. One Summary Cause claim £1,500. plus interest plus court cost.and one Small Claim, charges plus interest plus court costs. Only do one claim at a time, wait until that is settled before going ahead with the other. With the Summary Cause claim the court will return your papers with a return date and a calling date. You must then take them to a Sheriff Officers and get them to serve the claim on the bank.(This cost me £15.95)which you can also claim back. The court will send you a list of local Sheriff Officers you can use. You do include colum F in the spreadsheet when submitting your claim. Yes you need to do two seperate spreadsheets. I don't know which court you are using but it has been said a lot of them are refusing to take a second claim on the same account. There is stuff in this section relating to this. I'm not to sure about the 6 year thing. Why not just go back the five when you put in your claims. Maybe someone else could clarify this.

Thanks Scott. Can you confirm if column F is the 8% that the court said that I can add? I think I will just claim the 5 year you advised . Can you advise on form 1 of the Small Claim Summons section 7 if I can put refer to the attached (spread sheet) or i I f should put in a brief explanation? Also when I do 2nd claim do I have to start from the begining with the Bank. Sorry for all the questions My brain is a little pickled with all of this.

Yes colum F is the 8%. (7.State Details of Claim Here) have a look above your thread in Scottish Procedure and scroll down and you will find what to put in here. At the bottom put, Plus the expense of bringing the action.
