Hi! to everyone. I have recently just been made redundant, and as a result had to cancel all my direct debits, as I didn't receive my last pay. I explained my situation to the Bank Of Scotland, and initially they were quite helpful and because of the short notice given to them I expected some charges. Lo! and behold the letter dropped on the mat 2 days later.

I phoned the bank, hoping they would be more understanding, but no joy.

I will still have to pay the charge, but as my redundancy won't be paid for 8 to 12 weeks, I will be charged for not paying the charge and so on it will go. I have now paid the £5.00 fee for my last six years statements and intend to see the matter through to it's conclusion. I will also take the appropriate action to recover any unfair charges incurred after this. So here's hoping all goes smoothly, although somehow I doubt it.

 This was my original welcome post. Hope I'm not breaking any rules!

Hello and welcome,

I have already had one claim paid by Bos, that was a small claim. I have served my first Summary Cause on them and my court return date is the 13th March, have had no responce up till now. You mentioned you hoped the bank would br more understanding, no chance ! they screwed me for years. Now it's payback time.

Best wishes with your claim.

Regards.

Scott.

Hi! Maroondevo52. Hope your claim goes well. Keep me posted as I am Interested in BOS claims. I didn't realise it at the time but the Bank Of Scotland appears, by the posts I have read in any case, to be one of the worst banks to deal with on these matters. May have something to do with them having one of the highest charges, i.e. £39. Coincedence?

I have decided to send a letter off to the head office in Edinburgh, BOS, giving them their 40 days from receipt of my payment, in one of their branches, i.e. 01.03.07, countdown begins, for my statements. I amended a template for this reason. Copy on file.

Hi everyone, I was reading your posts and I would just like to say that I had a claim against bos for £1,500. I sent the usual letters and after the first one I got the usual letter saying that they needed another 14 days to look into my claim. I did not give them another 14 days, I just went down to the sheriff court and put in a claim against them, (summary clause). I then received another letter saying that they needed another 28 days to answer my original letter(at this time they had not received the court papers) and just before the 28 days where up they phoned me and offered a settlement of £1,500 plus interest and costs. I duly accepted and 2 days later I had the money in my bank. I did not stop my claim until I received the money. I have found bos a lot easier to deal with than Lloyds tsb who literally did not pay me out until I had my decrees. I hope that you all have it as easy as me as I am doing claims for my sons concerning bos and I am hoping to have an easy ride with them.

Hope you have good luck with them.:p

Just decided tonight to open a basic bank account with RBS. I really think BOS will close my account. Don't want to be caught short, but why should we have to depend on banks for our money, emphasis OUR? Why can't we go back to the Truckers agreement. We work for you, you pay us cash in hand.

  • 2 weeks later...

Just received my statements from BOS, in two lots, and was wondering what date I should start to claim from. Would it be from 5years back from todays date or does it have to be very precise?

Thanks for that stevokenevo, don't want to foul up at this early stage. I am using the spread sheet as a schedule of charges and trying to work out interest at compound rate, couldn't get it to work properly yesterday. I'll give it another go later on today.

Just been hauled up by the missus. Do I charge them for the full lot including compound interest at contractual rate in the preliminary letter, I know you dont charge judicial interest, or just the charges. Thanks

Hi am new to this forum. Very good. Well I think I have messed up big time with claiming back charges from BOS. I am claiming £2006 back over the 6 years. However been reading that I can only claim back £750 in scotland re small claims court. All the letters i have sent I have requested the full amount. I am at Letter before Action stage not had any reply from Repayment of charges letter. Oh no not very prof of me their probably laughing their head off. Any advise appreciated.

Bolo, You havent done anything wrong, in the prelim and LBA letters, you request the full amount (in case by some miracle they actually refund you ;-)

When it comes to court time, you can claim £750 + interest through the small claims court, or £1500 + interest using the summary cause claim which is similair.

Have you started your own thread, if not, start your own thead were your questions can be answered and you can keep us up to date with your progress

Good Luck

Just had a thought. If the banks claim the costs of a returned item comes to £39 a go, how come they only charged me £5 for 6 years statements in 7 seperate packages, especially when they can charge up to £10. Doesn't compute. Possible argument there?.
