HELP!!!

 

I'm really confused, I've just got a letter from my local court saying that

unless the parties comply with the order dated 8 august 2007 by 10th october 2007 then the claim and any counterclaim be struck out forthwith there after.

 

Can someone explain what this means??

HELP!!!

 

I'm really confused, I've just got a letter from my local court saying that

And what with the postal strike,does this mean ive missed my court date??

Can someone explain what this means??

Hi nakered - do you have the details of the Order dated 8th August from the court at all? If you could post them on here (without your personal details) someone should be able to help you!

 

The basis of the Order (dated 8th August) state that either:-

 

"the claimant must notify the court that the whole of the claim has been settled"

or

"the claimant or defendant must write to the court requesting an extension of the stay period, explaining the steps being taken towards settlement etc. The letter should confirm the agreement of all the other parties"

or

"all the parties must file a completed allocation questionnaire at the court. Where a settlement of some of the issues in dispute has been reached, a list of those issues should be attached to the completed questionnaire. The list must be agreed with the other parties and must indicate that it has been agreed."

 

I sent my AQ back in July, so does this leave the ball in Abbey's (ahem) court? :)

You should write to the court saying that you have submitted the AQ plus any fee to the court, and list any correspondence that you have had with abbey regarding settlement, also enclose copies, 10th October is tomorrow, so you are going to have to take it over there, do not trust the post. If in your opinion, there has been no attempt to try to settle by Abbey, then say so

Hi there

 

Not taking anything away from Lula (as if I could!!), but it is the 10th today, n'est pas??:confused:

 

So I personally would call the Court first thing tomorrow, and say you only just received the letter - the way the post is at the moment that is more than feasible. Then tell them that you have already submitted the AQ etc and take it from there.

The only problem with the above is, the letter from the Court came today (10th) due to the inadequacies of the Post Office, leaving no time to get my reply back.

I'll just have to hope that all the info I submitted back in July is sufficient.

I phoned the Court, but all they said was "check the letter dated 8th August"

Hmmm - not too worried, but the Court may strike it out (blimmin' Post Office!)

DOH., I just realised this, shame they didnt post it a bit sooner than last week especially as we have known for about a fortnight that there would be strikes.
