C - this is the one thing about this process that has been so important to me - its not so much getting back the charges and feeling empowered to control my financial life for a change, it was when I looked a 8 piles of statements from 8 different cards/bank accounts and started totting up the interest charges as well as the penalty charges - I have always wanted an Aston Martin and I could have had a new one if I hadnt paid all my money away!

 

Money on credit is sometimes a necessary evil, and for those banking employees who are watching these threads yes, there are some cases where "we" the consumer have only ourselves to blame, but I have no cards now other than an Amex charge card and a debit card for my current account, and I will certainly NEVER be applying for a new credit card.

C, this is such positive news

 

Looks like its all flowing the right way now - not sure how you are set right now but if the suggested repayment is manageable then at least it calms things down and at the same time Arrow are off your back and working for you (fulfilling your CCA request).....the cracks in MBNA are beginning to show ,so the refund of your charges, as Stan (Gor' bless 'im!) says WILL follow and that will help knock this debt or another one into better shape.

 

The boot is firmly on the other foot (and I am sure your feet are significantly more shapely than Gavin Theobold's, although Perseus may give you a run for your money!)

And when I get my charges back from MBNA the first thing I am doing (after a donation to this site) is to buy a toy Aston Martin and give it pride of place on the sideboard

 

It will remind me to never again allow myself to get sucked in by the credit cards siren song again :o

I feel awful - mainly for not being here to scream out loud about your CCA, or wonderful lack of it, and a little bit because I had about 15 too many G&T's last night and I feel like pants!

15 too many G&T's - it was the ones before that laid the foundations for major damage (and also meant I sent a really bitchy email to BCard who promptly settled my credit card claim but told me in no uncertain terms I hadnt got a leg to stand on with my charge card - well, ho hum, I know I do so 'ere we go again....

 

C - have you sent Mr Wareing his letter? Am gettting in the haboit of sending them registered on a Saturday so they have a nice bit of reading on Monday mornings!

Only posting this because:

 

1) havn't said hi for a while so....HI!

2) I noticed your thread had slipped down the page again, and we can't have that, can we!

 

3) the little I have read about the about the s85 thingy says that the debt remains the debt, and all that is potentially voided are the terms and conditions - if you borrowed money, had it paid into your bank account and paid back the lender from your bank account then couldnt pay, you have demonstrated receipt of the debt (its shown in your bank statements) and an awareness of the debt and of an agreement to repay on a structured basis (its also shown in your bank statements) and as such a court could not, even if there was no signed contract, say the original debt didnt exist. There are a load of threads on this somewhere but I can find them...will have a look later.
