Why in wales? I am in scotland as well and claiming against LTSB, i thought their registered address was in England!

I have been dealing with blackhorse now for three years and i have only ever had letters from scotland and wales?

will this claim be dealt with by llyods tsb solicitors?

My advice would be to go for the London address, so it falls under English law giving you one extra year of charges to claim back for. Also doubt it will go to court, will probably settle out of court so no need to make the trip south of the border.

 

As far as I am aware Black Horse is part of the Lloyds TSB group, hence the English address!!!

Hi All,

I've been fighting Black Horse Ltd and I have found out some info I'd like everyone to know about, especially if in their case Black Horse Ltd supplied information about them on credit files such as late payments and defaults (NOT Court judgements they are entred by the Registry Trust.

until Novmber 2006, Black Horse Ltd were incorrectly registered a Data Processor with the ICO, that means they were committing a criminal offence for not telling the ICO of changes under section 20 of the Data Protection Act (notification of changes).

When a company obtains a license to process data they have to put their registered office address on the register which is Gresham Street London, but they registerd it as St Williams House Tresillion Terrace Cardiff ( until I made them change it.

So anyone who has had data processed by them up to November 2006 has a good case for unlawfull processing which is a breach of the Data Protection Act.

Everyone should write to Black horse with this info and demand they remove any defaults from their Credit files or face a court case which they will have a real good chance of winning and getting compensation also if they passed the info on to debt collectors that makes it even more ammo against them, they passed it on with a dodgy license to do so.

no reply from prelim.lba sent 23/01/07.

got a letter today asking me to call and when i did they say there was no reason for me to call. i raised the subject of my letters and they told me my account had been allocated to a manager and i should get a call soon.

sounds ominus!

If they want to settle they can pay you the money, no requirement for discussion.

 

As the 14 days after the issue of the LBA is just about to expire, just file the claim form with the court, I recommend that you do not use MCOL, easier to complete the N1 in hard copy and post.

had a very amusing conversation with blackhorse. at some points i had to stop myself laughing but some how i managed.

 

i was ringing to confirm they had received my letters and got into a whole debate about their charges. they gave me the old you breached your agreement and incurred charges as per t&c. so i asked if there charges were fair etc and then they gave me an offer that they would apply no more charges to my account untill the end of the agreement if i paid on time every month and if i didnt persue my complaint any further.

 

they must of thought this was a good offer because the the nice lady on the phone seemed a little shocked when i refused and told her i would persue them through the courts if needs be for all charges that are deemed excessive and unlawful.
