      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I’ll look in the huge mound of paper they sent but everything was in date order. Those older vehicle ones has scans of long thin papers. Possibly pcn? 
But nothing if the like for this lost recent one.

I received all of these new sheets recently on 6th December 2022. 
 

Looking on these mosaics of mine. They were sent out 24th October 2019. 
 

I am going to call McDonald’s now. See what they say. Probably to no avail. Tho I am sure I had mechanical issues at that time. 

 

 

I’ve called McDonald’s. Gave me email. Said they may be able to help. 
let’s see what they do.

Waiting on reply from mcD manager. What Shouod I do about DCBL? To shut them up? And also ukpc. Shouod I email them met them know the manager is carefully considering it? 

 

McD manager said they can’t cancel it as it’s gone to debt collection
Now what can I do?

I can call them back up again no problem

Hi I think the term is back door ccj.

Moved address without informing.

1 year later found out I had a ccj.

There is a thread but can’t find it.

On phone and this app is a bit dinky with mobile.

Same situation.

Parking on private land. 
 

Someone did mention I may be able to get removed but need to pay £285 or something and it’s not a given. 
 

So as it is looks like I’m safe from another ccj. I’ve sent that to manager.  Need to email ceo. Might even get Ronald McDonald involved.

He never got back to my strong email telling me it's well within his right to help me with this and drop charges, he said as it's gone to debt collection nothing he can do. Which is rubbish, I called 2 times but wasn't in.. before xmas... I will try again today now!

The CEO of Mcdonalds??? I can't imagine someone who is managing 5000 restaurants is going to take the time to help me out...?

 

I am now concenred about this letter of claim?!

So it just happens that DCBL just randomly set up a solicitors then... oh yes love the law.

I will say at the end it will take you 3 minutes to call them up and get this sorted. I will provide parking control ltd number.

This was the last email i got from apparent ceo assistant.

 

"Thank you for getting back in touch and I certainly understand your disappointment.
 
I can confirm that restaurant team have looked into this further with UKPC, who informed us that this charge has gone too far for them to unfortunately be able to assist with this.
 
Please also be advised that it is motorists legal responsibility to update their details with DVLA when moving address.

So write a bad review then show McDonald’s and ask them to stand up? 
I’ve emailed her back with points made above but where it will go I’m not sure. 
Ive had no other correspondence in post about this from them lot. This manager needs to step up! 
Maybe go to area managers?

I got a reply from ceo assistant or whatever her role is..

As a company, putting in place enforcements within our car parks is only done after careful consideration and very much as a last resort. Primarily, we use parking measures to ensure there are spaces available for our customers’ vehicles, as well as to deter unwarranted or unreasonably prolonged usage of the facility.
 
I trust you will appreciate that in order to maintain a consistent approach; we have to adhere to the guidelines in place regardless of whether you were in the restaurant for the duration of the stay or not. As such, in a situation such as a clear contravention of parking regulations, we are unable to deal with any specifics or cases on an individual basis. Suffice to say, if a customer contravenes the clearly displayed parking regulations, they will receive a ticket.
 
Please be advised that restaurant team have contacted the parking company to try and assist, however due to the fact the charge is from 2019, they were, unfortunately, unable to do anything about it. I apologise for any disappointment this might cause.

I replied saying the power lays with her and Mcdonalds... Not them (parking fleecers).

But a lot for gelderd Road... Nothing in post code tho???

 

I have searched all 5 pages for 'gelderd road' and there is nothing about parking or signs..

And zero on the post code.

Does this mean they have not applied for parking permits?
