Thanks for the response. I didnt add the bit in red, think it must have been dx100uk.

 

Do you think we would be better off going for the £485 one or is that too low? If they pay out on that one then just work our way up the list?

Ok ill go with the £900 one then - a nice amount to get back if successful. 

 

Do you think I should send the letter of claim then? Is it by post? If so, ill send it by signed for post.

Yes letter of claim has been sent and should be received tomorrow. Also sent via email. 

 

The final draft was the same as the one above but without your red bit. 

 

What's your thinking about doing another one right away? Should we wait to see what happens with this one or is it best to send another right away?

On (insert date) I used your service via SendCloud to send a parcel with the above reference number.

 

The parcel never arrived at the location and I have been informed by your support team that it made it to your depot but then never made it out to a courier.

 

The shipping was purchased via the 3rd party SendCloud but I am pursuing yourselves as I am entitled to do under the Contract (Right of Third Parties) Act 1999.

 

The values of the items to me were xxxx. These items were being sold once they arrived at the final location but I am only claiming for the loss of the cost of goods.

 

I have spoken with your customer services team to try and resolve this but have been unable to. On one telephone call, your agent asked me which depot the boxes went to as they know in certain areas that the boxes are more likely to go missing. This box was a large box so it is unlikely to go ‘missing’ and if it was, then it would be easily found within your warehouse. Your agents have since confirmed that the box was no longer in your warehouse and is declared missing.

 

You have so far declined to reimburse me and I am therefore informing you that I propose to begin a county court claim against you within 14 days of this letter. I will not begin this process if you reimburse me for the lost box before that date.

Fair point, was just expecting a reply from them so was wondering if I needed to give them time due to bank holiday.

Any advice on this is appreciated..

 

The claimant used the defendant's service to deliver numerous items in one parcel, valued at £900.85 to a UK address. Reference number XXXXXXX. Defendant breached the contract by losing the items and refused to compensate the claimant without reason other than "its lost". The shipping was purchased via the 3rd party SendCloud but the claimant is pursuing the defendant as entitles to do so under the Contract (right of third parties) Act 1999. The claimant seeks £900.85 + interest pursuant to section 69 County Courts act 1984. 

 

Also, is there any easy way to copy and paste into this text box? I just had to type that out!

Im thinking we do box number 5 which is valued at £495.60. Get the smallest one in and then once we progress these, start putting the bigger ones through.

I received this last night. It refers to a tracking number that I don’t recognise. I have asked my warehouse if they know it.

Should you wish to submit a claim, could please provide us with the following details:
 
Parcel contents
Packaging details
Selling price/value
A copy of the invoice provided by Amazon that details the value of the item(s) sold and the postage costs you were charged

Should your claim be accepted, we will require payment details in order to process a BACS payment. So that we can process this as quickly as possible, please can you also provide the following:
- your bank sort code
- your bank account number (the short one, not the long card number)
- your name as it appears on your bank card

We thank you for your time and patience on this matter and ask that you provide the required information within 14 days, so we can resolve this as quickly as possible for you. We aim to process all claims within 28 working days of receipt.
 
As a self-serve company, we do everything possible to encourage customers to check our lists of non-compensated and prohibited items and we try to make this easy and transparent so that customers understand from the outset what we can and can’t carry. Certain items such as liquids are on the prohibited list because they are more likely to become damaged than others and therefore require a specialist carrier.
 
Please note: should you choose to issue a refund before this claim is finalised then you must do so at your own risk. If the parcel is located it will be delivered to the intended recipient and the claim will be closed

I’m unsure if it’s a standard paragraph as I haven’t had an email from them before. 
 

if that is there position do you think that changes anything? Given that the items were not damaged but lost.

The warehouse has come back to me and they have no record of the Evri reference number that was sent to me in the email. Perhaps Evri has confused my case with another? Do you think I should reply or leave it?

Court letter received today...

It contained the "Acknowledgment of Service" and Evri intend to defend this claim. They have 28 days to file a defence. 

I have also submitted the MoneyClaim for the 2nd box today.
