      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi razorc,

 

I had my parents address linked to my home address for some reason on my MS credit Card.

 

I rung Morgan Stanley and they said that they were unable to remove it. So I wrote to Experian and told them that I had not lived at my parents address for 18 years !!! I have just the other day received a letter back to say that the linked address has been removed. Al in all it took about 6 weeks.

i've noticed one address on it thats just over 6 years old

was wondering is it 6 years the link addresses stay on

 

i will write to them about the one thats over 6 years old thou , feckers

Thats great to know as I have a mass of linked addresses that are well over 6 years old I think I will contact experian to get this rectified. Its not that but Insurance Companies look at this if you make a claim and run searches on them also

Risky, write a letter to Experian and title the letter "NOTICE OF DISASSOCIATION".

In the letter explain that you are no longer or have ever been associated with that address. The letter is formal notice of removal, not complying is breach of the DPA for publishing incorrect Data.

Keep a copy of the letter and send recorded delivery or get a proof of postage receipt from the post office.

i noticed this on mine. have sent a request to Experian to have them removed. as i have lived at my present address for 7yrs now. i dont believe the linked addressess should linked anymore and should be removed asap.

 

see what happens.

just a bit of an update with regards to Link Addresses on your credit file. i have managed to get 2 removed from mine.

 

here is part of the reply i got which i hope helps others get there credit file in order.

 

We retain address links on your credit report for eight years from the date of information. Linked addresses are created when companies move a credit account from one address to another, or when they search more than one address when processing a credit application, or from information you have given to us. You may not necessarily have lived at a linked address for it to be shown on your report but you, or someone you have had a financial connection with, should have had some financial connection with it.

i fully agree with you midge.

 

this is something i cant get my head around.

 

if any employer was to give you a bad refrence you can have them done. as it might stop you moving on in life.

 

so how come you can have a bad refrence recorded against you for credit which could stop you moving on in life.

 

i think the guy that beat PC world and the creditor for the laptop. has pretty much proved it. if you have a default or something on your credit file that stops you moving on in life and bettering yourself.

 

i don't know maybe im barking up the wrong tree.

i know its not right it should be 6yrs at all. something to be looked at in the data protection act.

 

just list all the ones that are over 8yrs old for now and send them all back. they will have to remove them. and any address you are not linked to request to have the link removed.

 

if you need proof of this i can scan my letter with there statement in it.

Linked addresses should remain no longert han 3 years on your credit file, an address gets linked when

 

a) You have moved, and informed a creditor of your new address, this then links the two

b) You apply for new credit, and have not lived at your current address for the past 3 years. Creditors search your previous to ensure you have nothing "outstanding" or "adverse".

Not according to Experian as my credit file is full of ones from the nineties and early 00's and they haven't removed them after I asked them to.

 

How can cra's be forced to remove them if three years is all they should stay on your file for.

im not happy about it so have sent a email back stating that due to Barclaycard being the ones that had put a on my file unlawfully. i suggest they remove any links to do with them.

also asked for Experians guideline with regards to the 8yr rule with linked address.

 

not taking it lying down.

 

also whats are Experian linked to Abbey.
