they are being told to either wait and say they are happy with this or to pay your air fare if they want to carry on at their pace. they have been instructed to say what they want.

They may well decide that they cant be bothered after all- lets hope so as it will save all of the bother for everyone

Yes, but can you imagine people who can't do joined-up-writing having to work out what to do about someone in Peru?  I bet they don't know where Peru is!  I can just imagine the bird brains getting this from the court and not having a clue what to do!

I hope for their sake and mine they get the message, 

but at the same time, would be interesting to see what happens in terms of my expenses...

and I will definitely be putting in a counter claim for the countless hours I have wasted on this pointless exercise

dont be tempted to do that, just use CPR27.14.2(g) to ask for an  unreasonable behaviour costs order.

 

You maight want tio sue them for breach of the DPA/GDPR for unlawfully obtaining and processing your data though

so surprise surprise the claim has been discontinued...see attached.

 

Am I now able to sue them for breach of the DPA/ GDPR for unlawfully obtaining abd processing my data though???

the first thing to do is ask the court for a costs order for their unreasonable behaviour under CPR 27.14.2(g)

you  list your costs including 5 hours LiP research @£19.50/hr.

 

Now suing for brach of the GDPR is a possibility because the land isnt "relevant land" so there cannot be a keeper liability and thus no excuse to ask for the keeper details.

 

The argument that thery absolutely knew that the keeper was driving doesnt wash, they should have just sent you a letter without asking the DVLA where you lived if they had an honest belief.

 

however all such things are never certainties so ask for costs vis the court and if successful send a demand to the company asing for say £250 for the breach of the GDPR quoting VCS v Phillip as precedent

by writing to them at the court that issued the discontinuance notice

 

post up here what you intend to send so we can edit if necessary. It doesnt need to be an essay, just a simple request listing the amount you ahve spent on stationery, phone calls etc and the research costs.
