I have got on using my wifes details, as its a joint claim, is that ok for us both? i mean we dont both have to do it as my password still not working.

done the one, but cant do the other, should they have the same claim number but a different password, as i did the one first time, the other is still coming up with

This is one claim form with one claim number to joint defendants...are you listed as Mr & Mrs or 1st and 2nd defendants ?

We have received 2 separate claim forms. they show two defendants on each, one is me the other is my wife. on the one form i am first and my wife second, and vice versa on the other, they both have same claim number but different passwords......

You can email Northampton to acknowledge service if you cant resolve the MCOL

Hi, i have received nothing back from my letters.

 

i did acknowledge service as you said i must and i did notify of my intention to defend all,

 

do i have to let them know what my defence is now,

 

i think you said i must do this by 26th?

 

but i do not know what to say my defence is....

so because it could be a secured loan it might not be statute barred

if its the other loan

but their poc not any of their letter give an account number

nor have they replied to CCA/CPR

 

could it be worth ringing Blackhorse and asking them which one was sold on to ME III

and if its the non secured one check last payment date?

so i use that as my defence, in 47 part 3. it refers to assigment do i leave that in as there is nothing in the POC about the assigment that has taken place...?

i checked the amount with what is on the land registry site and the date when they say the debt was assigned to MEIii Ltd which is 16/07/2013 so it can only be the secured one.

we have also just found a 'letter of claim' which is dated 12 december 17, the claim form is dated 25 jan 18.

 

the letter of claim states it is based on the agreemnet dated 21 december 2007 which corresponds with the date on the land registry search we did too.

 

the letter refers to an assigmnet date of 16/07/13 and the 'client' as Me IiiLtd (marlin europe ii LTd- part of the cabot credit management group)- formerly black horse ltd.

 

it also lists some payments we made of 10 pound per month from 19/09/13 to 28/04/16 being the last one which were made via a company called Mortimer Clarke.
