Hello all great forum.

You guessed it

 

 

i just received a PCC from VCS after dropping my wife of at liverpool airport .

 

 

I stopped briefly in the entrance to a staff car park ,

 

 

the traffic enforcment van was no more than 5 metres away

 

 

the cheeky git even smiled at me ,

 

 

i thought nothing of it.

 

 

until today when i got this demand.

 

 

Any help advice would be greatly received.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi and welcome to CAG

 

VCS are part of the Excel group and moved from the BPA to the IPC on January 2015. This is quite important as on occasion, they say Excel and other times VCS; also the paperwork may have BPA on it rather than IPC.

 

The main signs upon entering the area are quite big and state 'No stopping' but what rules control this. These are made out on the signs dotted around the fences and on posts BUT you have to stop to read them. Damned if you do, damned if you don't.

 

Anyhoo, as VCS are part of the now infamous IPC any appeal will fail but that doesn't mean don't. Each appeal made costs VCS money. In the initial appeal to VCS, this costs time but when you escalate the appeal to the IAS, this costs them in financial terms.

 

After all that bluster, I suggest an appeal to both. Once you are rejected (and you will be) VCS would have to take court action to enforce the charge. So far this year, they have taken 7 cases that I know of to court. No idea if they have been won or lost but usually when a case is defended, they tend to fail.

You can also check with the local council to see if they have planning permission for the signs.

essentially the airport is governed by its own byelaws and VCS has no part to play in them.

 

 

They do not rely on the PoFA to create keeper liability

so the reality is there is nothing they can do to compel you to pay them,

they just blow hot air and issue threats but nothing more.

 

As IAS members you wont ge a fair chance to appeal so dont bother,

just ignore them up to the point where if they send you a lba

come back here for advice on how to respond.

 

 

It can seem a little worrying to try and take on board this advice when it ends with a warning about court action

but the reality is they dont issue claims for alleged breaches here

because they know they are going to lose any defended claim

but we must warn you that they may change their tactics

and try their luck in the hope they panic you into paying up at that point when they dont have proper claim to answer.

Thank you for the advice ,

 

i am not afraid of their bully tactics .

 

Should i just wait this out or should i appeal

 

i don't really want to have any contact as i always believe no contact no contract

and i dont want to let anything slip that could harm my case. .

 

I am expecting another letter as i picked the wife up a week later in the exact same place .

 

Also i forgot to mention the car is a licensed private hire taxi , i don't know if that has any bearing

Just some more information

 

 

the Black square shows where i stopped all be it 20 seconds ,

 

 

the red square is where the VCS camera van was (also parked in breach of there own rules).

 

 

you can see i was stopped in the entrance to a small staff car park

 

 

no signs i noticed and not on the red lines.

 

 

The camera van is PARKED up .

 

 

So is the VCS van breaking there own rules ?
