      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

just had my letter from A&l saying thet are going to close the account in 30 days, replied back saying thanks, but FOS have just fined you etc i wish to leave the account to furnish my Mortgage etc also please ammend credit file data and refund my charges you have just applied to my account lets see what happens!!!

Hi All

 

A&L have just filed an Acknowledgement of Service in response to my claim, stating they intend to defend all of my claim, as I understand it they now have 28 days to file a defence. Will they try to make me an offer prior to the court hearing date or just not turn up on the day, can anyone advise please about what I can expect next.

they will normally pay up around 28 day mark if not sooner don't panic a cheque will arrive soon , i did not have to file AQ and if you read around some threads very little of us got to that stage, just make sure you have a parachute account open because they will close it but you can contest it which what i am doing , (just received letter saying they are looking at my complaint!!)

Thanks for your reply. I have posted one somewhere on the site but don't know where as I am not brilliant with using it to say that yes they have paid up the full amount including costs less than 10 days after I filed the County Court Claim but stating in no way do they accept any liability for their charges being unfair. Also stated that as "I obviously don't agree with the terms and conditions of my account that they will be contacting me shortly to discuss its future operation" I take that to mean that they will be closing it. I am just waiting for 2 last cheques to clear the account and intend to close it anyway so hopefully I will get in first.

I want to thank everyone on this site for all the great advice and help and would say to all of you that haven't yet received your cheque, hang in there and be strong and you will get what you are due.

well quick update, Alliance did not agree with my proposal so i have now filed with FOS with regard to account closure

so let see what happens!!

brief update!! I proposed to A&L 10 days ago when they stated they where going to close ouraccounts, i asked that they kept our Joint account open no joy they than to close next weds, so i have now lodged a compliant with the FOS posted yesterday heres waiting!:-|

well more success, just heard back from FOS he has awarded me £200 compensation from Alliance & Leicester and he ask them to amend/correct my credit file and remove the adverse data, they have agreed to do this!! so it is worth wait and pursuing good luck to all

the adverse data this is what the credit agencies hold to which the banks notify them of missed payments etc 1,2 3 ....8 then default.

 

A & L stated i had missed payments re overdraft yet i hadn't it was caused by charges etc hope this helps
