OK, but send it special delivery for Monday(about £5 I think) not Saturday . You need to send an SAR by recorded delivery (£1 extra to 1st class stamp I think).

Can you please fill in the affixed budget sheet as it will help to go with your letter - it calculates automatically as you fill it in.

 

How much can you afford to pay towards the arrears on top of the normal monthly payment?

 

Also affixed is the Mortgage SAR I have used in the past. Make sure you send a postal order for the £10.00 fee and you must write on the back of the postal order these words "Fee for Statutory Request only NOT to be used as payment on account" Take a copy of both sides of the PO and keep safe with a copy of the SAR letter.

My plan was to offer them £50 on top of normal monthly repayment - that's what the orignial agreement with the court was for.

 

Thanks for the templates, quick question is the template you mentioned earlier about getting them updated with it all? Sorry just find some of this confusing at times!

Sorry not sure what you mean about getting them updated with it all ? The mortgage subject access request is for them to send you a complete history of your account so you can see what charges etc they have added to your account. It's what DX was talking about in post 45 above. However it's unliklely you would get the information back from them before the eviction notice comes, so it's more important to send the letter I have affixed together with the budget sheet tomorrow.

sorry it's me getting myself confused!

 

I have done the form - I assumed in step 2 that I put in the normal amount I would be paying and not include the arrears payment until step 4. I plan to get up early tomorrow to read it through again before posting.

Hi, I will catch up with you in the morning to check all is ok. On the budget sheet make sure there is not a lot left over in Step 5 or they will expect you to pay that to the arrears, it is acceptable to have a little left over for unexpected costs.

hi yes, just got in from PO to send it all in (45 mins in a PO queue but hopefully worth it!) budget sheet had just over £100 a month left over. Thank you so much for this, it means I can go to work on monday to my new job feeling a bit more positive!

£100 a month left over might be a little too much I would have suggested around £50. Never mind, hopefully it will work out OK. Did you send by special delivery for Monday ?

thanks, yeah it went for before 1pm on Monday. I'll let you know if/when they reply. I was worried if it was too little money left over the judge might say that it was too tight each month and kick me out!

Hi all

 

so came home from work last night to two things:

 

1 - statement from Paragon 'as requested' showing all debit and credits since taking out the loan including that I made payments in sept and dec of £400 each

 

2 - a letter dated 23 Feb saying they will be applying to the court for a warrant and are encouraging me to contact them within 7 days and that if they are able to agree to an acceptable agreement that is sustainable adn a payment is received in cleared funds the warrant will be canclled at no cost to me.

 

Pretty sure typically that they are closed on a Saturday (statement says Mon - Fri).

 

So does this mean they've ignored my offer of repayment?

 

Guess next step is to try and call them from work on Monday (hopefully boss wont be in!) and try to get to an agreement of repayment - I don't have the funds to clear the arrears in one go and I certainly can't ask anyone to lend it to me.

They sent me a full statement through with a list of charges etc, is that what I need to look at all this?

 

They sent me it without the SAR request?? They say /i requested it after sending the letter the Ell-enn did for me and lists all payments and charges since we took out the loan.

 

might be an idea to get an sar running?

 

 

investigate all the penalties and insurances they have levied that can be reclaimed too?

Sorry bit of a brain dump -thinking about re offering the £50 a month on top of monthly payments until I get more sorted out with pay etc and that I'll when I can increase it/pay what I can extra each month. Should I mention this to them or just stick with the £50 on top.

 

also should I reiterate parts of the letter ie will be appealing to the court as have offered to make payment, sent letter in etc?

 

If they still refuse should I try to discover from them the eviction date as I tend to work away from home during the week so unless I can pop home on Wednesday night to pick up any post, I won't be picking up post until next Friday now.
