I sent my a letter before action to the Halifax.

 

Last thursday I got their usual standard response stating that they had escalated my complaint to stage 2 of the complaints procedure and a senior customer services representative would be in touch to discuss yada yada yada.

 

Surprise surprise I have heard nothing.

 

However, they enclosed 6 years worth of bank statements with their letter which I was surprised about as for this particular account I had not requested them and nor had they made reference to the enclosure in the body of their letter. I immediately set about checking that the amount I was claiming was correct. Unfortunately, I couldnt make head nor tail of the transactions on the statements which I found to be very strange, until I checked the address details. They have sent me a complete 6 year pack of statements for another customer.

 

This persumably gives rise to a number of serious questions....

 

1. Can they be trusted to keep confidential personal data?

2. Is this a breach under the DPA?

3. If I have somebody elses statements, then where have they sent mine?

 

etc etc etc.

 

Not quite sure how to handle this blunder and would be grateful for a pm from a mod or Administrator.

Thanks spiceskull very interesting reading.

 

However, looking at that thread it seems that they only received some dd information relating to another customer.

 

I have 6 years worth of bank statements!!!!

 

This is a serious breach of DPA as it potentially (if i was that way inclined) would give me personal information, salary details, mortgate details etc etc etc!!!!! This is outrageous.

Clearly the details are different, but the general feel is that you:

 

a) have a duty of confidentiality regarding the information you received

b) have a duty to make that person aware of what has happened, and what you/they need to do

c) follow BF's advice regarding contacting the relevant people in the correct order

 

A mod/admin will pick this up in due course, so hold on...:rolleyes:

Thats exactly why I have come here. My bank have given me nothing but trouble throughout my financial difficulty. If there is anyway I can stir up trouble, or use this to the advantage of the poor account holder and myself then YES YES YES, bring it on!!!!!
