      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I had a loan though Ocean ,

financed by Endeavour in/around 2002.

 

I paid this off early in 2003.

 

I don't have any paperwork and I don't have the account number.

 

I have completed the form to send to Endeavour

 

but I am wandering from reading all these threads if this is going to get me anywhere.

 

Not sure how I can go about locating my account number

or whether indeed Endeavour will reply and I should write to HFC or HSBC instead.

 

Any advice before I start please would be much appreciated.

Hi, I sent the forms off to HSBC and they retruned with a letter asking for my ID and £10

but they did give me my account account number at the same time which was good news.

 

I returned it with a copy of my ID and the £10 about 2 weeks ago and now I wait with baited breath.

 

This was a very large loan which I took out years ago so I am keen to receive all my paperwork back and what I signed up for.

 

When/If I receive a reply , I will update this thread with any news. I feel hopeful now that they have actually replied and the fact they have given me my account number is a good start :-)

Just received all paperwork for two large loans with large PPI which was settled not long after i took out second loan.

 

Within a matter of months to be precise.

 

This was a £60k loan and paid it off quickly.

 

I now have account numbers and ppi signed paperwork.

 

I also have a letterheaded paper form Endeavur saying i need to go back to Ocean as the broker who sold me the insurance.

 

Rather than muck about I am going to send two PPI Questionairres.

 

One to Ocean and one back to Endeavour (VIA HSBC).

 

I have read threads on here that contradict ecah other.

 

One says that Ocean are responsible as the broker and another says Endeavour are as they took the money.

So which is true?

Yes .second loan refinanced the first and then paid second off within a few months. What is CCA and what does section 56 refer to? Ocean were the broker for both and endeavour fianced both loans

you would n't have signed a CCA agreement.

No. I am finding it tricky to evaluate how the final settlement figure has been calculated so not sure about a spreadsheet of income and outgoings in terms of these costs. What would you suggest?

that is trickier than it looks!

 

My paperwork shows payments, interest and the ppi fee on one of the loans.

 

On the other it shows payments and interest.

 

As I had already paid the large PPI payment when i took out the second loan it looks like i made further contributions to ppi on second loan. £13k.

 

So it is hard for me to work this all out.

 

it is not clear and conscise and i am normally quite good at understanding facts and figures.

 

I guess I will wait for my replies before taking further.

 

I know it would be easier to send to one of these compnaies but i am determined to do this myself rather than pay out 25% to anothe company for managing it.

I understand the concept and how to work our the percentage of ppi as part of the loan.

 

My first loan comes in at 26% and the second at 21.6%.

 

However, my second loan details the ppi costs per month and the instalments do not equate to 21.6% of the total monthly fee.

 

It works out at just under 20%.

 

So is this roughly about right?

 

Also, what I dont get is how I enter this on the spreadhseet

 

Claim From: what date is this (The date I started the loan??)

 

Claim To: what date is this (todays date...for now?)

 

Date of charge: What date is this (The date of each monthly PPI instalment???)

 

Amount of charge - once again is this the monthly fee i paid for PPI only?

I have just tried this.

 

I have entered the date the first loan started and the date of today.

 

I then entered each instalment I paid for ppi on each line on the second loan

(as this figure is quoted on my information received)

and then 26% of the total loan amount for each month on the 2nd loan.

 

The amount that it calculates is alot.

 

If this were true and Ii have got this correct then I can virtually free myself of my IVA.

 

Somehow it looks too good to be true.

 

If someone wants to work this out for me I would be happy to send over the figures and eternally grateful, as I am not sure.

 

I think I am just too stressed to do this right now.

 

Of course just because I might be due this does not mean I will free myself of the impending expected battle of responsibility

between Endeavour Finance and Ocean Finance. (Miracles can happen). :-)

i would scan up your agreements.

 

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all figures and dates. {DO NOT USE A BIRO OR PEN]

convert existing PC files to PDF [office has an installable print to PDF option]

..

goto one of the many free online pdf converter websites [http://docupub.com/pdfconvert/]

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

i'e Default notice dd-mm-yyyy

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

Just heard back from Ocean Finance...

who say that at the time they were called Ocean Finance

and now they are known as Ocean Finance & Mortgages Ltd

and therefore not the same company (or words to that effect).

 

They say that any obligations at the time would have had to be transferred to the new company

and as it was not in my case there is no case to bear.

 

Seriously!!! Anyone know if I can take this further elsewhere please. Thanks JJ

Consumer Credit Act Section 56. refers...

— (1) In this Act “antecedent negotiations ” means any negotiations with the debtor or hirer—

(a) conducted by the creditor or owner in relation to the making of any regulated agreement, or

(b) conducted by a credit-broker in relation to goods sold or proposed to be sold by the credit-broker to the creditor before forming the subject-matter of a debtor-creditor-supplier agreement within section 12(a), or

© conducted by the supplier in relation to a transaction financed or proposed to be financed by a debtor-creditor-supplier agreement and “negotiator ” means the person by whom negotiations are so conducted with the debtor or hirer.

Hi there.

 

 

Can anyone tell me if they have had or heard of a successful claim with either Ocean Finance or Endeavour Personal Finance.

 

 

I have asked before but throught I would see if there are any updates since my last try in 2013.

 

 

Ocean were the broker and Endeavour being the Creditors.

 

 

I have the agreements and neither party will admit to liability for a misold PPI agreement.

 

 

Spoke to Ombudsman and said I could write to them but may not get anywhere and waiting list is a year.

 

 

Also, the general consencus seems to be its a waste of time anyway so I am not sure what to do.

 

 

I was thinking of putting in the hands of a specific PPI claim company but I do prefer to do these things myself.

 

 

they probably have the better means to take it forward than I do.

 

 

The amounts we are talking about are quite large hence the reason I am trying to claim this back.

 

 

I did try at the time as they were two short term loans despite being quite large and litterally paid back within 3 months.

 

 

But the amount we paid in PPI was extorinate. i.e. the full amounts, twice!!

 

 

First loan paid off quickly with second loan as we neded a top up within 2 motnhs to do what we had to do.

 

 

On each loan we paid the PPI fully back twice,

despite the fact that the 2nd loan was also part paying the first.

 

 

At the time we had no choice so swallowed it.

 

 

I am saying this as I am not just on the bandwagon to get some money back.

 

 

I truly beleive it was wrong.
