Hi Kyb,

 

Pay by whatever means is good for you. At the gym sounds best as then you can see the payment being taken before your use your PIN code.

 

They are still being a bit evasive.

 

Write back and say :-

 

I need your assurance that this payment of £69.00 will settle my DLL account in full AND that you'll instruct ARC to desist from making any further demands.

 

I don't want to pay you, yet then be hounded further by ARC for any admin fees, penalty charges, etc.

Got a response from DL in the end

 

Hello Amy,

 

With reference to my previous email, I can confirm all of the points you have raised. The £69.00 will be in full and final settlement of the account with David Lloyd and I will instruct ARC there is nothing more to pay.

 

We need to take the payment as soon as possible to be assured of this.

 

Going to go down this week to pay.

 

I've had another letter from ARC saying how they are 'disappointed' I've not paid them and will be taking further action of some sort. Also they have been phoning me but I've told them I will only speak to them in writing & hang up straight away. Do I need to do anything else to deal with them or just pay DL and continue to ignore ARC?

Hi Kyb,

 

Go and pay the gym. Tell them you expect them to ensure that ARC stop harassing you.

 

No need to respond to ARC at all. You have all you need from the gym in that last email.

Hi again!

 

As David Lloyd insisted me paying via the phone & not telling me when they start/finish I have kept missing them when I go down to pay and as a consequence haven't been able to pay the £69. I've mad an appointment today to pay the £69 which will finally be done!

 

However this morning I received a letter from 'Major Law Solicitors' saying a I know owe £225.12 with court proceedings of £86.12. A County Court Claim has ow been prepared and is ready to be issued against me by Northampton County Court. However they are acting on behalf of ARC. If I ignore the letter they may proceed to issue the claim in 14 days time and without further notice.

 

Should I ignore this like ARC & just pay David Lloyd as they have said they will deal with them or does this now change things?

I assume that you have by now paid the £69.

 

If this is the case, you can ignore Major Law for now. And ignore ARC too.

Yes I paid the £69 Saturday afternoon and the manager said he will now deal with the rest.

Hopefully that'l be the end of it all!
