Hii every one,

 

 

I have a serious problem with Xercise4less gym as

 

 

i signed up for one year contract

 

 

by the end of my contract I have had no intention to continue

 

 

i went to the gym and asked the reception lady to make a cancellation for my membership in November

she advised me that i have to cancel my membership by 14th December to avoid extra charges,

 

 

i came back on 14th of December and made my cancellation,

 

 

i received a letter from Harland group asking me for £34.99 for a returned payment £25.00 and £9.99 for January monthly installment

they asking me for another 9.99 as a fee for cancellation if i want to cancel!!!!!

which is very weird as i already cancelled my membership and I have already on my hand a copy of cancellation.

 

please advice me what to do and where to go to complain such fraud/false re question of payment as i really want to take this further.

 

I already read back all terms & conditions and didn't nothing mentioned about that at all.

a DCA is not a bailiffs

and have

MO SUCH legal powers

 

 

so don't fall for their tricks!

I'd read some of threads and got a good information on how to deal with them, but my question now is, my contract is 12 months till the end of December 2014 so did I have to cancel my membership in the first place ? or it is automatically would be cancelled as i made my cancellation on 14th December 2014.

typically they would wrongly assume rollover even if you didn't cancel

Hi Modey and welcome to CAG

 

Do not worry about Harlands' threats of adding further fees or admin charges. They cannot enforce these fees.

 

The demand for a cancellation fee is probably just Harlands being greedy. The demand for a fee for the unpaid DD is nothing to worry about.

 

Do not speak to Harlands by phone at all. If they call you, hang up !

 

Have you checked that you have paid 12 months' fees in total ?

 

If you have, I suggest you write a simple letter to Harlands saying :-

 

I cancelled my gym membership during months 11 and 12 of the membership.

 

I spoke twice, during November and December 2014, to Xercise4Less staff who told me me membership would end after the 12th month's fee was paid and, after that, I would owe nothing more.

 

If you make any further demands for monthly fees, for admin fees or a cancellation fee, I will make a formal complaint to Trading Standards.

 

Send this to Harlands. Take the letter to the Post Office and get a free Certificate of Posting. Keep this so have proof of posting.

 

Let us know how they respond.

Thank you Slick for your reply i will send this letter tomorrow, and see.

i already have a record of payments for 12 months and also a copy of my cancellation form submitted by hand in my local gym, i do belive that they extended my contract for January without my consent and ignored my cancellation.

Hi Modey,

 

Are you keeping a record of every contact by phone, email or letter form Harlands/CRS.

 

You could sue Harlands but it would need to be for a nominal amount at a judge's discretion. The idea is that, once you get judgement against Harlands, if they contact you again, you could seek an order against them and/or further damages.

 

Other options include ignoring Harlands/CRS completely, or tackling them head-on. I'd suggest the latter option and would now write to Harlands as follows:-

 

Dear Harlands,

 

As I told you in my letter of 2nd February, I cancelled my gym membership verbally and in writing in November and December 2014 and have proof of this. Yet Harlands/CRS continue to make demands for more monthly fees and admin fees.

 

You have also demanded a cancellation fee of £9.99 and I require that you show me exactly where in the membership T&C's this is required.

 

If I receive any further demands from Harlands/CRS, I will take further action. I have a log of all the calls and emails from you.

 

Yours faithfully,

 

Get a Certificate of Posting for this at the PO and keep us informed.
