On the face of it this is unfair treatment by the Halifax.

 

Are you saying that you have had a debt which you have been paying off by instalments for some time as a result of an agreement with Halifax and that you have kept the terms of the agreement correctly without any late payments or any other problems?

 

Have you got a written agreement about this repayment plan? What does it say?

Hi, yes have been paying off for some time,

 

 

Halifax passed it over to a debt collection agency very soon after agreement was made,

 

 

it then got passed back to Halifax as debt company could not contact me as I had moved a couple of times,

 

 

I still continued to pay,

 

 

Halifax have now passed it on to 1st credit,

 

 

I must admit that over the years a couple of payments have been missed,

 

 

yes the debt is on my credit file

How long ago were the missed payments - how many exactly and how many correct payments have there been until now?

 

If you have missed payments then this breaks the agreement. However, if you resume the payments and they are accepted without any protest and if those payments continue for a reasonable time then it may be possible to say that the installment agreement has been restored.

Please can you give us those details.

 

Have those missed payments been paid up or is the agreement still in arrears?

 

Please can you stay with the thread because it gets tricky for us to get back into it if you drop out for three days with unanswered questions

I have probably missed 4 payments in 7-8 years, and have made sure if I missed a payment the next payment was double,

 

 

I haven't got the original agreement,

 

 

this debt is for a outstanding credit card,

 

 

I was made redundant and fell behind with payments,

 

 

I went into debt consolidation but wasn't getting anything paid of with their charges,

 

 

so made agreements with lenders to pay, this was 2006 I think

send them a CCA request!!

they'll have a job getting anything other than the application form.

However - keep making the payments religiously until you know that you are clear. There is no room here for errors.

 

In response to their request for a statement, then if there is a CCA, I would suggest that you then write to them and point out that you are party to a payment agreement with the original creditor and that you have no intention of altering the agreement or of entering into any discussion about it.

Ask them why they believe they need a statement and what authority if any exists which requires you to provide one.

 

However, follow DX's advice first

If 12+2 days have elapsed since you sent the DCA a CCA request and they havent complied, then stop paying until they do.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..
