Hi,

 

My son noticed that 3 payday loans (2 x Wonga 1 x Sunny) had been paid into his Halifax account on Saturday. These immediately got trandfered into my daughters Natwest savings account then straight into her Natwest current account. From there they were moved elsewhere (currently trying to find out where).

All transactions were done over the internet even the getting of the loans.

The total amounts to around £750!

Halifax at first said they will pay the money back into his account on Monday (today) so that he can pay the companies back but have now reneged on that promise.

Natwest are investigating where the money went on hop 4 out of the current account.

Halifax advised us to contact the payday loan companies direct which i did...

Wonga were helpful stating that we can pay it straight back as long as the bank sends a letter saying it was fraud.

Sunny wont do anything without a Crime Reference Number from the police and will be taking the first installment no matter what happens anyway.

 

My son hasn't been able to use his online banking for months as it kept saying he was lock out so silly of him he just left it, well he did tell the bank and they were sending out new credentials.

 

What do we now with relation to the payday loan people whilst the banks chase around to find where the money ended up?

For your benefit please cancel the CPAs on these... Its important as theyll end up raiding the bank account.

How an earth did someone get through 3 accounts with 2 different banks?

Sorry to sound stupid, CPA?

The authorisation for the payment from his account.

He Must inform his bank of the fraud an insist that No payments are to made to these lenders.

 

 

The bank Cannot Refuse the Cancellation.

 

 

Your son must get a crime/incident No. from the police.

 

 

His bank and his sisters bank must be taken to task over the transfer of the fund into her account and out of it.

A formal complaint is needed.

There is no evidence of a Continuous Payment Authority (CPA) being setup using the sons debit card.

 

These fraudsters have been applying for payday loans - not necessarily in the sons name nor using his card details for repayment. But they have used the sons sort code and account number so that the loan amounts were paid into his account.

The fraudsters have then transferred the money from the sons account to the daughters account and then elsewhere to try and launder the money.

 

This means that both the son and daughters accounts were/are compromised by the fraudsters. (It would be worth verifying whether their mail is secure and if their details with their banks are correct and up to date).

 

I think Action Fraud is probably the most appropriate organisation to report the fraud to.

What do i send\say to the 2 payday loan companies who seem disinterested in the fraud, is there a template i can send them?

 

 

You don't need a template, just a short notice of disassociation.

 

 

To the compliance manager of the PDL.

 

 

I refer to the fraudulent loans obtained in my name, please take note I xxxxxxx xxxxx did not apply for and have not benefitted from any monies xxxxxx payday loan company has paid in to my account.

 

 

I have no knowledge as to where any funds were later transferred.

 

 

All liability for any funds so processed via my personal bank account is totally refuted.

 

 

Furthermore All CPAs are now formally cancelled and my bank is instructed not to allow ANY such payments.

 

 

This matter has been reported to police and action fraud.

 

 

Send by signed for post, check delivery date.

The loans were not necessarily applied for using the sons debit card. Which means any CPA will not necessarily be coming from the sons account.

 

Unless his card details have been compromised in addition to his internet banking details - which is unlikely but I suppose not impossible.

I would get your son to file a report with Action Fraud, obtaining a Crime Reference Number.

Then write to the payday loan companies informing them that he did not apply for any loans (and of course include the Crime Reference Number).

I've just been called by the Sunny Compliance team (they have my number as i called them on Saturday asking WTF).

They not only want a CRN but also a letter from the Halifax confirming that this is fraud.

Is this normal or should i stop all direct contact and send the words in the letter or email that were given above?

If Sunny phone again inform them a response is in the post and all communication Must be in writing.
