Can anyone tell me the reference to case law where it establishes that one clause of a contract cannot be enforced where there has been a failure to enforce another clause? I'm after the reference to the case and a link to the details, if this is available online.

The only thing that comes to my mind is something like a tenancy agreement where it says something like the landlord may take action if the tenant fails to comply with a part of the contract like keeping the place in good repair etc.
