Hello,

 

My landlord has asked for increase in rent now that my 6 month fix term has come to a end.

 

My questions is how much notice does he need to give me?

"Your landlord must give you a minimum of one month’s notice (if you pay rent weekly or monthly). If you have a yearly tenancy, they must give you 6 months’ notice. "

 

I can see from gov.uk but I paid for my rent upfront so how much notice do i need?

None at all if you accept & pay the increase or if AST contains a rent review period/date.

Increase cannot be backdated and would normally take effect from next rent due date. ! month is reasonable IMO

If you disagree with increase then ask LL to provide a s13 Notice of increase, you can appeal to FTT (LVA) within 30 days for a binding new rent to be set for 12 months.

 

 

If AST states rent payable monthly, it does not matter, from rent point of view, if you agreed to pay x months in advance.

 

 

LL cannot require you to sign a new AST or accept a rent increase, but expect a s21a in response.

LL cannot increase rent within 12 months of starting a tenancy; Housing Act.

he must issue you with a formal S13 notice for a rent increase which will explain all that and your other rights of appeal etc.

However he can issue you with a S21 notice as said above.

Thank you for the reply I can see there is little room for negotiation to date I have received only a email informing me of the increase I suppose that is not correct notice?

 

My main question is and I would appreciate it if someone could clarify this for again...

 

The above website says that rent paid monthly requires 1 months notice, rent paid per year requires 6 months notice,

 

whereas my rent and contact were paid 6monthly so I am wonder what the required notice if any is?

It actually says ' for yearly tenancies it is 6months notice'

 

 

A yearly tenancy, I understand, is one that is renewed at the end of each year and paid in advance ( normally for a minimum of two years ).

 

 

so the LL can increase the rent six months into the second or third year by giving notice at the end of the fist or second year, on completion of the contract period, if no further contract entered into.

 

 

Regarding your particular contract, It would depend on how it is worded, if it is based on a sum to be paid monthly, but you chose to pay the full amount up front then it is still a monthly period, now it has gone periodic. However if it said six months in advance then it would be a six monthly period, so you would be on a six month period and he would need to give 6 months notice, as required by the housing act, notice equal to the length of the rental period, for any other period that is not monthly, yearly etc. ( pointless ).

 

 

Anyway having said that, if it has now gone periodic, LL cannot increase rent within 52 weeks of the start of the tenancy, however if this is your second period then he can. and you either just agree or wait for a section 13 notice, which you can challenge and ask for an assessment.

You can also move or he can issue a scetion21 notice.
