Hi Everyone,

Would appreciate if someone could give me some advice on this one.

I had a Barclays Loan for which got into arrears since October.

In November, I managed to get a temporary suspension of the repayments

by paying only £15/month for 3 months and then review the loan in January.

Due to several factors and due to my work ( travel abroad frequently ),

this didn't happen so

i was sent a Notice of Default Letter letter dated from 4th February

requesting repayment in full or contacting by the 4th march to renegotiate the loan.

I contacted them only on the 4th march and

was informed that there was no negotiation possible

and that they would cancel my loan

and then also close my current account with barclays.

I offered to repay my normal instalments plus £100 every fortnight to clear the £748 in arrears but was completely refused.

I'll now lose my current account and will only be able to get a cash card account which is basically useless...

On the other hand,

I had a previous loan with Barclays for which I received approximately £2000 refund.

This was due to an apparent inadvertent incorrect information sent to customers about the loan.

They reviewed it and refunded me.

With this current loan being cancelled,

how can I find out if I'm in the same situation and am due a refund?

You need a SAR request, Why not move banks before the account is fully closed? Youll still stand a chance to get a decent account :)

Try Coop :), First Direct :) or RBS arent so bad :)

We could do with some help from you.

its unusual for a DN to require the repayment of the whole loan.

dx

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi Nalg and welcome to CAG

Stay off the phone and deal with matters in writing only, so you have a clear papertrail of all that's discussed.

You should get a new a/c sorted asap, before the DN on your CRA files makes this too difficult.

If the bank has added any penalty charges to the a/c, these should be reclaimed in full to reduce the balance owed. Such charges remain unlawful.

It may also be useful to tell the bank, in writing, that their refusal to consider and/or accept your repayment proposals may be a breach of the BCOBs regulations which they are duty-bound to observe. Accordingly you want to offer once more the following repayment proposal - £xxx per month, etc to clear the balance in approximately x months.

You could also mention that you require them to refund in full any penalty charges added to the a/c as they remain unlawful at law.

:-)

We could do with some help from you
