hi i received a letter from bryan carter solicitors saying

 

dear miss ali

as you have failed to make repayments on the above account

we have now issued litigation proceedings in the county court,

you will recieve the claim form in 48 hours direct from court.

 

the claim form will show the following

principal balance £560.61

interest £136.97

court fees £50.00

solicitor costs £30.00

outstanding balance now to pay £560.61

 

you can telephone us to discuss this matter

 

please note that the claim includes additional items set above which lowell financial limited is entitled to recover,

a proportion of any payment made may be allocated to your principal balance

with the reflected on your credit file with reference agencies.

 

if judgement is entered againest you and remains unsatisfied it will remain on the judement register for six years

and you may have difficulty in obtaining further credit,

Why in the world would you lose your home for that amount?

no i dont the letter doesnt even say what its for

 

Your bound to worry. It's only natural.

 

Just write back and say that you have no idea what this is about, so if they can't provide information about it, will they kindly sod off and leave you alone.

this claim is for 343.54

the amount due under an agreement between the original creditor and the defendant

to provide finance and/or services and / or goods

 

the debt was assigned to/purchased by lowell portfolio i ltd on the 27/02/2009

and notice served pursuart to the law of property act 1925

 

particulars

re:shop direct

 

and the claimant claims 343.54

the claimant also claims interest pursuant to s69 county court act 1984 from 27/02/2009

to date at 8% per annum amounting to 136.97

Your timeline is as follows..

 

Date of issue 25.02.2014 + 5 for service = 01.03.2014 + 14 days to acknowledge claim = 15.03.2014 + 14 days to submit defence = 29th March 2014.

 

Do you owe the debt - does it have any default /penalty charges that could be reclaimed.

 

If this is your debt, why did you cease payments ? When did you enter into the agreement with Shop direct ?

 

If you have a dispute for a good reason, and wish to defend, then you need to acknowledge the claim - that is confirm it has been received. The instructions for doing this are on the claim form. You need to register on Money Claim online (MCOL) then using the claim reference and the password which is hidden a way down the claim form you need to follow the instructions to acknowledge receipt and to say if you are going to defend the claim that way you will get a further 14 days.

 

If you do not have information, such as statements etc, that will help you defend the claim then you will need to obtain these - if you let us know yes or no, then we can provide you with draft letters.

 

If you believe you owe this money and have no reason to dispute it then you will need to come to an arrangement with the claimant to enter into a repayment plan.
